L. whereas the best interests of the child should always be the primary consideration in all decisions concerning children and whereas every child has a right to know and be cared for by their parents; whereas in the case of separation, every child has a right to maintain personal relations and direct contact with both parents on a regular basis, unless it is contrary to the child’s; whereas the personal relations and direct contacts of the child with its parents may be restricted only to protect the best interests of the child;

Calls on the Member States to protect the best interests of the child in cross-border family proceedings, including by ensuring that laws and procedures do not discriminate between the parents on the basis of their nationality, country of residence or otherwise, and by refusing to consider that the best interest of the child is to remain within a particular Member State’s territory regardless of other factors such as his safety or his right to maintain personal relations and direct contact with both parents on a regular basis;
