(12) Small scale fisheries play an important role in the Union, from a biological, economic and social perspective. Considering the possible impacts of small scale fisheries on stocks, it is important to control that fishing activities and fishing efforts of smaller vessels are in compliance with the rules of the common fisheries policy. For this purpose it is necessary to obtain position data of those vessels. Therefore, Member States should be able to track all fishing vessels, including fishing vessels which are less than 12 metres' length. For vessels 12 metres' length it is now possible to use mobile devices which are less expensive and easy to use. In any case, the implementation of these measures must not entail an unbearable burden for the fleet, especially the small-scale fleet, and must benefit from aid from the European Maritime Fisheries Fund.

(30) Recreational fisheries play an important role in the Union, both from a biological, economic and social perspective. Considering the significant impacts of the recreational fishing on certain stocks, it is necessary to provide for specific tools allowing an effective and exhaustive control of recreational fisheries by the Member States. A registration or licensing system should allow a precise census of physical and legal persons participating in recreational fisheries and the collection of reliable data on catches and practices. The collection of sufficient and reliable data on recreational fishing is necessary in order to evaluate the impact of such fishing practices on stocks and provide Member States and the Commission with the information necessary for an effective management and control of marine biological resources. This should be done through a common form for all Member States.

Recital 55
(55) The data collected by Member States is also of great value for scientific purposes. It should be clarified that scientific bodies of Member States and Union scientific bodies may be provided access to the data collected, properly anonymized, in accordance with Regulation (EC) No 1224/2009 , in particular to vessel position data and fishing activity data. Finally, the fishing activity data collected by Member States is also of value for the statistical office of the European Union (Eurostat) who can use it to provide statistics on fisheries.

Article 59 a – paragraph 1
1. Member States shall ensure that procedures are in place to enable that all fishery products are weighed upon landing on systems approved by the competent authorities and that weighing is carried out by operators registered for the weighing of fisheries products, unless the Member State has adopted a sampling scheme approved by the Commission and based on the risk-based methodology adopted by the Commission in accordance with the procedure referred to in Article 119. In cases where all products landed are to be transported for sale to a port other than that of the landing within the same Member State, the products may be weighed at the port of destination immediately prior to sale or storage. In that case, the fisheries products shall be accompanied by the corresponding transport document or equivalent document with the estimated catch quantities (processed weight) which shall not exceed the maximum margin of tolerance established. For the same purpose, Member States may permit fisheries products to be weighed after transport from the landing port provided that they are transported to a destination on the territory of the Member State concerned and that this Member State has adopted a control plan approved by the Commission and based on the risk-based methodology adopted by the Commission in accordance with the procedure referred to in Article 119.

3. Personal data contained in information referred to in Article 110(1) and (2) shall not be stored for a period longer than 5 years, except for personal data that is necessary to allow the follow up of a complaint, an infringement, an inspection, a verification or an audit or on- going judicial or administrative proceedings, which may be retained for 10 years. If the information listed in Article 110(1) and (2) is retained for a longer period of time, the data shall be anonymized. For the purposes of Article 109 paragraph 2) point b) indent (x) in respect of data from closed circuit television systems on board fishing vessels, the retention period shall not exceed one year.
