Calls on the Member States to simplify procurement tendering processes by using the flexibility of the EU’s new procurement framework and to enhance opportunities for SMEs by using digital tools and platforms to expand cross-border procurement; stresses that green public procurement can make an important contribution to building a sustainable economy; regrets that the ‘lowest price criterion’ is often still decisive in the tendering processes, often to the disadvantage of SMEs;

Considers that the objectives of the ‘SME Strategy for a Sustainable and Digital Europe’ should be fully matched by financial and other resources to enable Member States to promote SME transition towards sustainability and digitisation, which is of particular importance for the least developed countries and regions in the context of cohesion policy; stresses that such objectives cannot be contradictory and must, on the contrary, accompany measures to safeguard employment with rights and improve working conditions and consumers´ rights in the various sectors of activity;

7. Underlines the fact that late payments account for a quarter of all SME bankruptcies in the EU; urges the Commission to swiftly equip the Late Payment Directive1 with strong monitoring and enforcement tools so as to ensure and promote prompt payments as a norm across the single market; calls upon authorities on European, national, regional and local level to set the right example by paying SMEs on time. __________________________ 1 Directive 2011/7/EU of the European Parliament and of the Council of 16 February 2011 on combating late payment in commercial transactions, OJ L 48, 23.2.2011, p. 1.

7a. Calls on the Commission to examine the need to introduce a European legal framework on franchising as many SME companies are franchise takers of big multinational companies and often faced by an uneven negotiating position and suffocating contract conditions.
