Recital A
A. whereas Article 42 of the Treaty on the Functioning of the European Union grants special status to the sector in respect of competition law, stipulating that it applies to production of and trade in agricultural products only to the extent determined by Parliament and the Council, account being taken of the common agricultural policy (CAP) objectives set out in Article 39 of the Treaty on the Functioning of the European Union;

2. Considers it essential to clarify the provisions governing producer associations and interbranch organisations in Regulation (EU) No 1308/20131, particularly as regards competition policy, and to consolidatethat, in order to provide greater legal certainty and improve the position of farmers in the food chain, it is essential to step up consistency between, on the one hand, the progress made by Regulation (EU) No 2017/23932 (the ‘Omnibus Regulation’), supplemented by the judgment of the Court of Justice of the European Union of 14 November 2017 (‘the Endives Case’)3, thereby providing greater legal certainty and improving the position of farmers in the food chain; _________________ 1 OJ L 347, 20.12.2013, p. 671.which established that the collective activities of producer organisations and their recognised associations are necessary to attain the CAP objectives as defined in Article 39 of the Treaty on the Functioning of the European Union when the joint activities are genuinely exercised, thereby contributing to improving farmers’ competitiveness, and as a result, activities such as production planning and contract negotiation are exempt from Article 101 TFEU, and, on the other hand, the recognition of an implicit derogation from competition law when it comes to fulfilling the responsibilities assigned to producer organisations under EU legislation, as recognised by the Court of Justice of the European Union in its judgment of 14 November 2017 (the ‘Endives’ case)3; _________________ 2 OJ L 350, 29.12.2017, p. 15. 3 Judgment of the Court of Justice of 14 November 2017, President de l’of the Autorité de la concurrence v Association des producteurs vendeurs d’endives (APVE) and Others.

Calls for the provisions of Regulation (EU) No 1308/2013 enabling supply management measures to be adopted for cheese, ham and wine with a protected designation of origin (PDO) or a protected geographical indication (PGI) (Articles 150, 167 and 172) to be extended to cover all products with a PDO or PGI in order to increase the possibilities of matching supply with demand;

Ccalls on the Commission to launch an in-depth analysis on the extent and effect of buying alliances on the economic functioning of the agricultural and food supply chain; takes the view, in that regard, that the rapid concentration of the retail sector at national level, and the alliances being formed among large-scale retailers at European and international level could raise concerns about possible strategic alignments, reduced competition and reduced scope for investment and innovation in the food supply chain;

Considers it essential to keep within DG AGRI all competencies relating to the application of Articles 209 and 210 of Regulation (EU) No 1308/2013 and relating to state aid used to promote the development of agricultural and forestry sectors and of rural areas, thereby ensuring the expertise needed to address the specific nature of these sectors and full consistency with the objectives and support provided under and in accordance with the CAP.
