(25) Furthermore, iTransport infrastructure is the backbone of the economy and society as a whole. Some transport infrastructure is critical to ensure the good functioning of vital societal functions, and is therefore a pillar of the strategic autonomy of the Union. Investments, interests and presence of third country-owned companies in European strategic - and sometimes even military - infrastructure, such as ports, airports and container terminals, are increasing. In this context, those companies' participation in, or contribution to, projects of common interest can threaten the security or public order of the Union and undermine the Union's resilience. Therefore, it is crucial to prevent third-country participation that is likely to affect the security or public order of the Union. It should be possible for the Commission to adopt an opinion addressed to all Member States if it identifies several foreign investments that, taken together, are likely to impact the security or public order of the Union. This could notably be the case where several foreign investments present comparable characteristics. These include where the foreign investments are made by the same foreign investor, or foreign investors presenting similar risks, or where several foreign investments concern the same target or the same infrastructure, including trans-European infrastructure for transport, but also for energy and communication. Member States and the Commission should discuss the risk analysis and the possible ways to address the risks identified in the opinion.

(27) For greater clarity, the list of projects or programmes of Union interest should be listed in Annex I. These should include any foreign investments undertaken on the trans-European networks for transport, energy and communication, as well as programmes providing funding for research and development for activities relevant for the security or public order of the Union. Due to the importance of these projects and programmes for the security and public order of the Union, Member States should screen foreign investments into Union undertakings that are part of or participating in these projects or programmes, including those that receive funding from the Union. Special attention should be paid to any foreign investment in, or contribution to, strategic infrastructure for the trans-European transport network, such as ports, airports and terminals, and the European transport corridors established by Regulation (EU) 2024/1679 and the cross- border sections, which ensure the continuity of a project of common interest on both sides of the border between two Member States or a Member State and a neighbouring country.

(31a) Without prejudice to the cooperation mechanism, it is vital to pay more attention to third country-owned companies' participation in, or contribution to, projects of common interest or critical infrastructures that are strategic for the Union, in order to allow public authorities to take action if that participation or contribution is likely to affect the security or public order of the Union and does not fall within the scope of this Regulation. Member States may make observations to other Member States and to the Commission. If necessary, the Commission may request additional information and monitor the situation.
