4a. Notes that the EU institutions have no legal obligation to recognise the specificity of sport when they apply the provisions of the Treaty, and that, as a consequence, the very notion of specificity remains vulnerable to the fluctuating decisions of the courts;

Commission, [2006] ECR I-6991.
