2a. For the purposes of implementing this directive, the Member States shall be entitled to engage in intergovernmental cooperation to facilitate the restructuring and operation of the European defence industry. This directive must not become an obstacle preventing the Member States from entering into specific agreements that may facilitate the transfer of defence equipment between themselves.

Article 4 – paragraph 1
1. The transfer of defence-related products between Member States shall be subject to prior authorisation, except where national regulations provide for exceptions. No further authorisation by other Member States shall be required for the transit through Member States or for the import in other Member States of defence-related products without prejudice to the application of provisions necessary for the protection of public order such as the safety of transport.

4. Member States shall determine all the terms and conditions of transfer licences, in particular anycluding any specific limitations on the export of defence-related products to recipients in third countries, having regard to the risks for preservation of human rights, peace, security and stability created by the transfer. Member States may pursue and extend existing intergovernmental cooperation in order to achieve the objectives of this directive.
