This Directive shall apply without prejudice to Articles 30, 45, 46, 55 and 296 of the Treaty, with no justification being necessary in the case of defence equipment.

Article 3
Contracting authorities shall treat economic operators equally and non- discriminatorily and shall act in a transparent way. It shall be borne in mind that the Member States’ foreign policy should not be conditioned or restricted in respect of third countries by the principle of alignment. Similarly, the extension or, if appropriate, amendment of the lists of weapons must be undertaken in accordance with the subsidiarity principle.

Article 4 – paragraph 1 − subparagraph 2
However, the Member States shall be entitled to determine all conditions governing licences and, in the case of public service and public works contracts as well as public supply contracts covering in addition services and/or siting and installation operations, legal persons may be required to indicate in the tender or the request to participate, the names and relevant professional qualifications of the staff to be responsible for the performance of the contract in question.

1a. Close study should be given to the administrative burden placed on the Member States as regards the certification procedure or the monitoring, control and , where appropriate, liability deriving from the granting of licences.
