Article 2 – paragraph 2 a (new)
2a. Member States may, after consulting the Commission, refrain from applying this Regulation to undertakings carrying on the occupation of road freight transport operator if their business is confined solely to national transport services with little influence on the transport market on account of - the nature of the freight carried or - the short distances travelled.

Article 8 – paragraph 1
1. For the purposes of Article 3(d), the requirement as to professional competence shall be satisfied if the person(s) who is (are) deemed to satisfy it pursuant to Article 4 possesses (possess)person(s) concerned shall possess knowledge corresponding to the level of training provided for in Section 1 of Annex I in the subjects listed therein. ItThis shall be established, following training involving by means of a compulsory awrittendance at courses of a total duration of at least 140 hours, by means of a compulsory written examination which examination which, if the Member State in question so decides, may be supplemented by an oral examination These examinations shall be organised in accordance with Section 2 of Annex I.A To that end, Member States may decide to provide for compulsory training leading to the examination.

A warning shall be sent to an undertaking if the competent authority establishes that an undertaking runs the risk of no longer satisfying the requirements proviThe competent authority may require undertakings whose authorisation has been suspended for in Article 3. If it is established that one of those requirementswithdrawn to ensure that its no longer satisfied, the warning shall grant a time limit for the undertaking to rectify the situation within the following limits:transport managers pass the examination referred to in Article 8 prior to any rehabilitation measure.
