Recital 7
(7) To focus efforts where they are most needed, this Directive should only cover the most found single-use plastics products, which are estimated to represent around 86% of the single-use plastics found, in counts, on beaches in the Union. It should nonetheless be emphasised that the use of plastic in food containers for human consumption is highly regulated in the Union.

(2) 'single-use plastic product' means a product that is made wholly or partly from plastic and that is not conceived, designed or placed on the market to accomplish, within its life span, multiple trips or rotations by being returned to the producer for refill or re-used for the same purpose for which it was conceived' means conceived, designed or placed on the market to be used once, for a short period of time and, based on a harmonised methodology, has been identified as accounting for a significant proportion of marine litter found in the EU;

Article 9a Incentive schemes 1. Member States shall include in the operational programmes financed by the European Maritime and Fisheries Fund (EMFF) financial support for the production of an action plan, produced jointly together with producer organisations, shipowners’ associations, public bodies, environmental conservation organisations and the sector as a whole. In that connection, measures shall be included for the retrieval of waste and fishing gear, as well as the improvement of waste management infrastructure and management processes on vessels and in ports. 2. Member States shall set up deposit, refund and take-back schemes for fishing nets in ports, to be included in the action plan drawn up pursuant to paragraph 1. 3. Member States shall set up a system for the control and registration of nets, to be included in the action plan drawn up pursuant to paragraph 1. 4. Member States shall design support for R&D for the development of more traceable and less polluting nets in the form of incentives for firms manufacturing fishing gear. They shall include Investment in the development of new materials with a lower environmental impact.

— Food containers, i.e. receptacles such as boxes, with or without a cover, designed and intended to be filled at the point of sale, used to contain food that is intended for immediate consumption from the receptacle either on-the-spot or take- away without any further preparation, such as food containers used for fast food, except beverage containers, plates and packets and wrappers containing food. This provision shall not apply to packaging which is intended to extend the shelf-life of pre-prepared foods.
