(11) Union assistance under this Regulation ishall be designed to complementand implemented taking into consideration complementarity with the various other tools for implementing of Union policies on democracy and human rights, which. These tools range from political dialogue and diplomatic demarches to various instruments for financial and technical cooperation, including both geographic and thematic programmes. It will also complement the more crisis-related actions under the Instrument for StabilityParticularly, though not exclusively, it should be taken into consideration that one of the main characteristics of the EIDHR is that it can operate without the explicit concern of third countries. In any case when identifying areas for complementarity with other policy instruments of the Union the overall and specific objectives of the instrument, as set in this regulation and other programmatic documents should always be respected.

2. Article 4c Participation of civil society organisations and other non-state actors 1. The procedure for the adoption and revision of strategic programming documents under this Regulation as referred to in Article 2 of the Common Implementing Regulation and Article 4 of this Regulation shall allow for a genuine, timely and thorough consultation with representatives of civil society organisations and other non-state actors. The Commission, when preparing and implementing those consultations, shall ensure a timely and appropriate transmission of relevant information so as to ensure the meaningful participation of the abovementioned institutions and civic actors. 2. Civil society organisations shall also be given opportunity to submit written comments. 3. Representatives of civil society shall take part, provided there is no direct conflict of interest, in tenders' evaluation committees and in project evaluations. 4. For the purpose of this Article, civil society organisations shall be selected using transparent and objective criteria.

Article 4e Eligibility 1. Without prejudice to the limitations inherent in the nature and the objectives of the action as provided for in Article 8(7) of the Common Implementing Regulation, participation in the award of procurement contracts or grants, as well as the recruitment of experts, shall be open without limitations under the European Instrument for Democracy and Human Rights (EIDHR). 2. Under the EIDHR the following bodies and actors shall be eligible for funding in accordance with Articles 4(1) and 6(1) (c) of the Common Implementing Regulation: (a) civil society organisations, including non-governmental and private non-profit organisations and agencies and political foundations, institutions and organisations and networks thereof at local, regional, national, European and international level; (b) public sector non-profit agencies, institutions and organisations and networks at local, national, regional and international level; (c) international and regional inter- governmental organisations; (d) natural persons, indigenous communities, entities without legal personality and, in exceptional and duly justified cases, other bodies or actors not identified in this paragraph, when this is necessary to achieve the objectives of the instrument.

Article 4f EU Delegations 1. EU Delegations in third countries shall be responsible for ensuring that local civil society organisations are consulted according to article 4a and able to submit comments to strategic programming documents, in particular on the listing of priorities under country-based support schemes. 2. EU Delegations shall engage regularly with local civil society organisations and human rights defenders in a safe manner, while providing, whenever possible, the necessary publicity for call for proposals and technical guidance and support towards application procedures.
