(10) The Agency should also be able to issue non-binding guidelineopinions to assist regulatory authorities and market players in sharing good practices. If a national authority fails to comply with the Agency’s opinion, the national authority concerned must publicly provide sufficient justification. The Agency may, if it deems necessary, formulate a new, binding opinion, giving sufficient reasons.

3. The Agency may provide an opinion to the European Network of Transmission System Operators for Electricity as provided for in Article 2d(2) of Regulation (EC) No 1228/2003 and to the European Network of Transmission System Operators for Gas as provided for in Article 2d(2) of Regulation (EC) No 1775/2005 on the technical or market codes, on, having consulted the national authorities as regards areas of jurisdiction, must provide strategic guidelines on the technical codes to the European Network of Transmission System Operators for Electricity and to the European Network of Transmission System Operators for Gas. In accordance with these guidelines, ENTSO and ENTSOG must prepare a draft set of technical codes and submit it to the Agency for approval. The European Network of Transmission System Operators for Electricity and the European Network of Transmission System Operators for Gas must agree on, and submit to the Agency, the draft annual work programme and the draft 10- year investment plan.

Market codes 3a. The Agency shall submit strategic guidelines on the market codes to the Commission for approval. This approval shall allow the Agency to prepare the draft set of market codes. Subsequently, the Agency shall, openly and transparently, consult all market participants involved and shall keep them informed and fully involved in the preparation of this draft. On the basis of this consultation, the Agency shall define the draft set of market codes and submit it to the Commission for adoption and relevant monitoring.
