(3) The requirements for the protection of the health and safety of persons and, where appropriate, domestic animals and property are already covered by Directive 2006/42/EC of the European Parliament and the Council of 17 May 2006 on machinery. In order to ensure the consistency of that Directive with the Framework Directive, it it is thus appropriate that essential environmental protection requirements for the design and construction of new machinery for pesticide application are also included in the Directive 2006/42/ECat Directive, while ensuring that they support and facilitate the implementation of the Framework Directive's provisions relating to the maintenance and inspection of machinery already in professional use.

(4b) Machinery for pesticide application includes self-propelled, towed, vehicle- mounted, semi-mounted and airborne machinery, as well as stationary machinery intended for pesticide application, both for professional and consumer use. It also includes powered, or manually-operated, portable and handheld machinery with a pressure chamber. Taking into account this broad and diversified product range, certain requirements of this Directive should apply only to specific types of machinery.

(4c) This Directive is limited to the essential requirements with which machinery for pesticide application must comply before being placed on the market and/or put into service, while the European standardisation organisations are responsible for drawing up technical standards providing detailed specifications for the various categories of that machinery in order to enable manufacturers to comply with those requirements. Given that the application of these harmonised standards remains voluntary, the requirements set out in this Directive should be as clear and detailed as possible so as to ensure the desired level of protection of human health and the environment, while also ensuring consistency with the principles of the New Approach. It is also essential that all interested parties, including industry, farmers and environmental organisations, are equally involved in the establishment of the harmonised standards, so as to ensure that they are adopted on the basis of a clear consensus amongst all stakeholders.

2.4.1 Definition Machinery for pesticide application' means machinery specifically intended for the application of plant protection products as defined in Regulation (EC) N° […] or of biocidal products for pest control belonging to product types 14 to 19 as defined in Annex V to Directive 98/8/EC. For the purposes of this Directive, machinery used for the application of materials containing pesticide shall be considered as machinery for pesticide application and shall comply, where relevant, with the supplementary requirements set out in this section.

2.4.4 Filling and emptying Machinery must be designed and constructed so as to facilitate precise filling and complete emptying and to prevent any unintentional dispersal of pesticide during these operationswith the necessary quantity of pesticide and ensure easy and complete emptying, while preventing spillage of pesticide during these operations. Machinery must be fitted with adequate equipment to avoid contamination of the water supply source during these operations. Where applicable, filling devices must be designed to avoid any return of liquid from the tank to the filling supply.

Where appropriate, an even distribution and homogeneous deposition of pesticide must be ensured.

It must be shielded on all sides, and the nozzles at the extremities of the rows must be directed inwards to avoid spraying adjacent areas.

(7) In order to ensure an optimal management of the electricity transmission network and to allow trading and supplying electricity to retail customers across borders in the Community a European network of the transmission system operators should be established. Its tasks should be carried out in compliance with Community competition rules which remain applicable to the decisions of the European network of the transmission system operators. Its tasks should be well- defined and their working method should be such as to ensure efficiency, representativity and transparency. Given that more effective progress may be achieved through an approach at regional level, transmission system operators should set up regional structures within the overall cooperation structure, whilst ensuring that results at regional level are compatible with codes and investment plans at Community level. Cooperation within such regional structures presupposes effective unbundling of network activities from production and supply activities in the absence of which regional cooperation between transmission system operators gives rise to a risk of anti-competitive conductMember States should promote cooperation at regional level, and regulators should monitor the effectiveness of the network at that level.

(8a) To ensure greater transparency of the entire electricity transmission network in Europe, the European Network of Transmission System Operators should draw up, publish and update a "road map" for the electricity network in Europe. All electricity transmission networks and possible regional connections should be included in this road map. The Agency for the Cooperation of Energy Regulators should be consulted in the development of the road map, in particular in checking its consistency with the 10-year investment plans. The road map should be submitted to the Commission for review.

5. The European Network of Transmission System Operators for Electricity shall publish, every two years, a Community- wide 10-year network investment plan every two years, with the possibility of extension of this timeframe where necessary. The investment plan shall include the modelling of the integrated network, scenario development, a generation adequacy report and an assessment of the resilience of the system. The investment plan shall, in particular, build on national investment plans and on the Guidelines for Trans- European energy networks in accordance with Decision No 1364/2006/EC of the European Parliament and of the Council. The investment plan shall identify investment gaps, notably with respect to cross border capacities.
