For the purposes of this Directive, in order to evaluate whether the third-country national concerned possesses higher educational qualifications, reference shall be made to International Standard Classification of Education( ISCED) 1997 levels 5a and 6;"

Articles 5 and 6 shall be without prejudice to the competence of the Member States to determine volumes of admission of third- country nationals for highly qualified employment. Member States shall retain the possibility of refusing residence permits for certain professions, economic sectors or regions.
