(15) The SST support programme should be financed by the Union in accordance with Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25 October 2012 on the financial rules applicable to the general budget of the Union18. The maximum amount of Union funding for the SST support programme should be drawn from relevant programmes provided forEUR 70 million in current prices. It should primarily be drawn from the programmes dedicated to space policy in the multiannual financial framework for 2014- 2020, i.e. EGNOS/Galileo and Copernicus, preferably through specific budget lines under these programmes. Article 4a 1. A device may only be used for the purpose of a genetic test if the indication is given by persons admitted to the medical profession under the applicable national legislation after a personal consultation. 2. A device may be used for purposes of a genetic test only in a way that the rights, safety and well-being of the subjects are protected and that the clinical data generated in the course of the genetic testing are going to be reliable and robust. 3. Information. Before using a device for the purpose of a genetic test the person mentioned in paragraph 1 shall provide the person concerned with appropriate information on the nature, the significance and the implications of the genetic test. 4. Genetic counselling. Appropriate genetic counselling is mandatory before using a device for the purpose of predictive and prenatal testing and after a genetic condition has been diagnosed. It shall include medical, ethical, social, psychological and legal aspects and has to be addressed by physicians qualified in genetic counselling. The form and extent of this genetic counselling shall be defined according to the implications of the results of the test and their significance for the person or the members of his or her family, including possible implications concerning procreation choices. 5. Consent. A device may only be used for the purpose of a genetic test after the person concerned has given free and informed consent to it. The consent has to be given explicitly and in writing. It can be revoked at any time in writing or orally. 6. Testing of minors. In case of minors the informed consent of the parents or legal representative shall be obtained; consent must represent the minor’s presumed will and may be revoked at any time, without detriment to the minor. In case of incapacitated adults not able to give informed legal consent, the informed consent of the legal representative shall be obtained; consent must represent the presumed will and may be revoked at any time, without detriment to the person. Devices predicting a genetic condition that has implications for diseases in adulthood or for family planning shall not be used in minors unless preventive means are available before reaching the age when the person tested is able to give consent. 7. A device may only be used for the determination of sex in connection with prenatal diagnosis, if the determination fulfils a medical purpose and if there is a risk of serious gender specific hereditary diseases. By way of derogation of Article 2(1) and (2) this also applies to products which are not intended to fulfil a specific medical purpose. 8. The provisions of this Article on the use of devices for the purpose of genetic tests do not prevent the Member States from maintaining or introducing for reasons of health protection or public order more stringent national legislation in this field.

The national authorities in charge of those procedures, when examining an application with respect to a bioequivalent generic medicinal product, should not request information concerning the patent status of the reference medicinal product and should not, but they should be allowed to examine the validity of an alleged violation of intellectual property rights should the bioequivalent generic medicinal product be manufactured or placed on the market subsequently to their decision. ConsequentlyThat responsibility may not be removed from Member States. Without prejudice to the responsibility of Member States to examine information, intellectual property issues should neither interfere with nor delay pricing and reimbursement procedures in the Member States.

Article 8 Remedies procedure in case of non- compliance with the time limits related to the inclusion of medicinal products in health insurance systems 1. Member States shall ensure that effective and rapid remedies are available to the applicant in case of non- compliance with the time limits set in Article 7. 2. For the purposes of the remedies procedure Member States shall designate a body and entrust it with the powers to: (a) take, at the earliest opportunity and by way of interlocutory procedures, interim measures with the aim of correcting the alleged infringement or preventing further damage to the interests concerned; (b) award damages to the applicant in case of non-compliance with time limits set in Article 7 where damages are claimed, unless the competent authority may prove that the delay is not imputable to it; (c) impose a penalty payment, calculated by day of delay. For the purposes of point (c), the penalty payment shall be calculated depending on the seriousness of the infringement, its duration, and the need to ensure that the penalty itself is a deterrent to further infringements. Member States may provide that the body referred to in the first subparagraph may take into account the probable consequences of potential measures taken under the present paragraph for all interests likely to be harmed, as well as the public interest, and may decide not to take such measures when their negative consequences could exceed their benefits. 3. A decision not to grant interim measure shall not prejudice any other claim of the applicant seeking such measures. 4. Member States shall ensure that decisions taken by bodies responsible for remedies procedures can be effectively enforced. 5. The body referred to in paragraph 2 shall be independent of the competent authorities in charge of controlling the prices of medicinal products for human use or in charge of determining the range of medicinal products covered by health insurance systems. 6. The body referred to in paragraph 2 shall state reasons for its decision. Furthermore, where that body is not judicial in character, provision must be made to guarantee procedures whereby any allegedly illegal measure taken by the independent body or any alleged defect in the exercise of powers conferred on it can be subject to judicial review or review by another body which is a court or tribunal within the meaning of Article 267 of the Treaty on the Functioning of the European Union and independent of both the competent authority and the body referred to in paragraph 2. The members of the body referred to in paragraph 2 shall be appointed and leave office under the same conditions as members of the judiciary as regards the authority responsible for their appointment, their period of office, and their removal. At least the president of that body shall have the same legal and professional qualifications as members of the judiciary. That body shall take its decisions following a procedure in which both sides are heard, and these decisions shall, by means determined by each Member State, be legally binding.deleted

There is a need for an improved understanding of health and disease, in people of all ages, so that new and better prevention measures, diagnosis and treatments can be developed. Interdisciplinary, translational research on the patho-physiology of disease is essential to improve the understanding of all aspects of disease processes, including a re- classification of normal variation and disease based on molecular data, and to validate and use research results in clinical applications. Translational research projects aimed at applying laboratory findings more quickly and efficiently into medical practice should be particularly supported, especially in those areas of high unmet need, such as haematology/oncology, rare diseases and antimicrobial resistance.

(8) In order to maintain and increase the Union's industrial leadership there is an urgent need to stimulate private sector research and development and innovation investment, promote research and innovation with a business driven agenda and accelerate the development of new technologies which will underpin future businesses and economic growth. Part II "Industrial leadership" should support investments in excellent research and innovation in key enabling technologies and other industrial technologies, facilitate access to risk finance for innovative companies and projects, and provide Union wide support for innovation in small and medium-sized enterprises, primarily by lowering the entry threshold for small and medium-sized enterprises.
