ia. sees that investment arbitration is best channelled via a separate international court where only the states can file a claim. An investor can seek to resolve their disputes with host states through domestic courts but only in those cases where there is clear evidence that the sole purpose of a host country's action is to harm, prohibit or confiscate the investor's property;
