Recital 6 a (new)
(6a) Given the requirements of the Treaty to ensure a high level of protection of human health and of the environment, the Charter of Fundamental Rights of the European Union and its objectives of a high level of environmental protection and the fundamental right to working conditions that respect workers' health, safety and dignity, the primary objectives of the Farm to Fork strategy among which the reduction of the negative impacts on public health and the EU strategic framework of health and safety at work 2021-2027, a reduction of pesticide use is needed to protect the health of citizens, including farmers, bystanders and inhabitants of agricultural areas. Scientific studies underline the adverse impacts of pesticide exposure on human health. Farmers, workers, operators, bystanders and inhabitants of agricultural areas are particularly exposed to pesticides. Pesticides have been shown to drift, leading to contamination and exposure at farm distances from the location of application. Links have been shown between exposure to pesticides and elevated rates of chronic diseases as well as different forms of cancers, neurodegenerative disorders, diabetes and ALS. Many pesticides have endorcrine disrupting characteristics. There is also evidence for the association of exposure to pesticides with respiratory problems, cardiovascular disease, autoimmune diseases, chronic kidney disease, aging and chronic fatigue syndrome. The exposure to certain pesticide groups, for example organophosphate pesticides, is associated with increased risk for cognitive and behavioral deficits and neurodevelopmental disorders in children. Studies have pointed at the associations between the exposure to pesticides and altered menstrual cycles, negative impacts on the reproductive systems and fertility disorders. Links have also been shown between premature or spontaneous abortions, and associations between maternal exposure and neurodevelopmental alterations in newborns. Exposure to pesticides has also been linked to intergenerational impacts, highlighting the need to act to reduce exposure now for the health of future generations. The body of evidence underlines that the full health impact of pesticides may be highly underestimated, which requires a precautionary and preventative approach. Pesticides also have cumulative and synergistic impacts given the effects of long-term exposure, mixtures and co-formulants.

Recital 25
(25) Use of plant protection products may have particularly negative impacts in certain areas that are frequently used by the general public or by vulnerable groups, communities in which people live and work and ecologically sensitive areas, such as Natura 2000 sites protected in accordance with Directive 2009/147/EC of the European Parliament and of the Council67 and Council Directive 92/43/EEC68 . If plant protection products are used in areas used by the general public, the possibility of exposure of humans to such plant protection products is high. In order to protect human health and the environment, the use of plant protection products in sensitive areas and within 310 metres of such areas, should therefore be prohibited. Adjacent to organically farmed land, these buffer zones should be further expanded to 50 metres for the use of all plant protection products not authorised for organic farming, so as to avoid contamination of organic crops with these substances. Article 25 – paragraph 2
2. Each Member State shall designate a competent authority or authorities of public health and environment responsible for the implementation of the system for the training and certification of all training referred to in paragraph 1 and for issuing and renewing training certificates, updating the central electronic register, providing proof of entry in the central electronic register and overseeing that the tasks referred to in paragraph 1 are carried out by the body that provided the training.

Article 26 – paragraph 1
1. Each Member State shall designate a competent authority of public health and the environment to establish, oversee and monitor the operation of a system of independent advisors for professional users. That system may make use of the impartial farm advisors referred to in Article 15 of Regulation (EU) No 2021/2115, who must be regularly trained and can be funded under Article 78 of the same regulation. Advisors shall not have any commercial or private interests in the plant protection product industry.

Article 34 – paragraph 1
1. The methodology for calculating progress towards achieving the two Union 2030 reduction targets and the two national 2030 reduction targets until and including 2030 is laid down in Annex I. This methodology shall be based on statistical data collected in accordance with Regulation (EC) No 1185/2009 and the mean application rates of chemical active substances based on their representative uses, which have been evaluated under Regulation (EC) No 1107/2009. .

Article 39 – paragraph 1
Member States may recover the costs related to carrying out their obligations under this Regulation by means of fees or charges. In order to refinance the costs, Member States shall examine the viability of introducing a risk-based levy on plant protection products.
