4a. Commission decisions on the procedure for attesting the conformity of construction products which have been issued pursuant to Article 20(2) of Council Directive 89/106/EEC shall remain valid and equivalent to the measures, designed to amend non- essential elements of this Regulation by supplementing it, which have been adopted in accordance with Article 19 and the regulatory procedure with scrutiny referred to in Article 51(2). They shall apply to products falling within their respective scope independently of the type of harmonised technical specification on which the declaration of performance is based.
