Where the supplier has failed to supplymake the digital content in accordance with Article 5or digital service available at the time agreed upon with the consumer in accordance with Article 5, or within the time limit indicated in Article 5(2), the consumer shall call upon him to make the delivery within an additional period of time appropriate to the circumstances. If the supplier fails to supply the digital content or digital service within this further time limit the consumer shall be entitled to terminate the contract immediately under Article 13.

2. The supplier shall bring the digital content in conformity with the contract pursuant to paragraph 1 within a reasonable time from the time the supplier has been informed by the consumer about the lack of conformity with the contract and without any significant inconvenience to the consumer, taking account of the nature of digital content and the purpose for which the consumer required this digital content. The consumer shall be entitled to withhold the payment of any outstanding part of the price or, where the lack of conformity is minor, an appropriate proportion thereof, until the supplier has brought the digital content or digital service into conformity with the contract.

6. Where the consumer terminates a part ofgives notice terminating the contract in accordance with paragraphArticle 5, paragraph 2 shall apply, with the exception of point (b) in regards to for the period during which the digital content wasor digital service was no longer in conformity with the contract. The supplier shall reimburse to the consumer the part of the price paid corresponding to the period of time whenafter which the digital content was notor digital service was no longer in conformity with the contract.
