(17) It is necessary to establish a Union Product Compliance NetworkEuropean Market Surveillance Forum, hosted by the Commission, aimed at coordinating and facilitating the implementation of joint enforcement activities by Member States, such as joint investigations. This administrative support structure should allow the pooling of resources and maintain a communication and information system between Member States and the Commission, thereby helping to strengthen enforcement of Union harmonisation legislation on products and deter infringements.

This Regulation lays down rules and procedures for the provision of compliance information about certain products that are the subjee present regulation has the objective to improve the functioning of the single market of goods by strengthening market surveillance of goods covered by legislative acts of the Union acts harmonising the conditions ofor their marketing of those products. It establishes a framework for cooperation with economic operators in relation to such products. , in order to ensure that they meet the requirements guaranteeing a high level of protection of public interests such as health and safety in general, health and safety in the work place, the protection of consumers, protection against counterfeit products, protection of the environment and security.

Article 15a Risk assessment 1. Risk assessment shall be based on available scientific or technical evidence. Risk assessment shall be carried out in accordance with the general risk assessment methodology and, where appropriate, Commission guidelines on the application of that methodology to a specific category of products. The Commission shall, by means of implementing acts, adopt the general risk assessment methodology. Those implementing acts shall be adopted in accordance with the examination procedure referred to in Article 63. For products subject to Regulation (EC) No 1907/2006, risk assessment shall be carried out as appropriate in accordance with the relevant parts of Annex I to that Regulation. 2. In the context of the risk assessment, market surveillance authorities shall take into account the extent to which the product complies with the following: (a) any requirements laid down in or pursuant to Union harmonisation legislation that apply to the product and relate to the potential risk under consideration, taking full account of test, inspection and calibration reports or certificates attesting conformity and issued by a conformity assessment body accredited in accordance with Regulation (EC) No 765/2008, including assessments drawn up pursuant to Regulation (EC) No 1907/2006, for instance in connection with registration, authorisation, restrictions or reporting; (b) in the absence of requirements laid down in or pursuant to Union harmonisation legislation, specific rules laying down health and safety requirements for such products in the national law of the Member State where it is made available on the market, provided that such rules are in accordance with Union law; (c) any European standards the references of which have been published in the Official Journal of the European Union. 3. Compliance with any of the criteria referred to in points (a), (b) and (c) of paragraph 2 shall raise a presumption that the product adequately safeguards the public interests to which those criteria relate. However, this shall not prevent market surveillance authorities from taking action under this Regulation where there is new evidence that, despite such conformity or compliance, the product presents a risk. In that case, the market surveillance authority shall demonstrate that the product presents a risk. 4. The feasibility of obtaining higher levels of protection of the public interest concerned and the availability of other products presenting a lesser risk shall not be sufficient reason to consider that a product presents a risk. 5. The Commission may, on its own initiative or at the request of a market surveillance authority, have a risk assessment carried out by a Union testing facility, in accordance with Article 20. Such assessment shall be binding on all stakeholders. 6. In cases where Member State risk assessment practices differ and result in divergent interpretations as to the necessity of measures in respect of similar products, the Commission shall provide guidance on appropriate risk assessment practices. The Commission shall be assisted by the Scientific Committees established under Commission Decision 2004/210/EC and shall take into account all available scientific and technical evidence relating to the risks under consideration.

The administrative coordination groups shall have the following tasks: (a) to coordinate the enforcement of Union harmonisation legislation within their area of competence; (b) to establish appropriate communication channels between national market surveillance authorities and the Network; (c) to establish and coordinate common actions such as cross-border market surveillance activities; (d) to develop common practices and methodologies for effective market surveillance; (e) to inform each other of national market surveillance methods and activities and to develop and promote best practices; (f) to identify issues of shared interest relating to market surveillance and suggest common approaches to be adopted.

Article 34 – paragraph 1
1. The Commission shall develop and maintain an information and communication system for the collection, processing and storage of information, in a structured form, on issues relating to the enforcement of Union harmonisation legislation. The aim is to enable sharing of relevant data between Member States and to allow the Commission to monitor market surveillance activities. The Commission, single liaison offices, market surveillance authorities and authorities designated in accordance with Article 26(1) shall have access to that system. The information and communication system shall be linked through a common interface to the existing electronic system of the customs administration, based on Regulation (EU) No 952/2013 of the European Parliament and of the Council laying down the Union Customs Code as well as to the Community Rapid Information System RAPEX, based on Directive 2001/95/EC of the European Parliament and of the Council on General Product Safety.
