Considers that increasing prisons’ capacity is not the sole solution to overcrowding, as the prison population tends to rise at the same rate as prison capacity; calls nonetheless on Member States to allocate appropriate resources to refurbishment and modernisation of prisons in order to protect the rights of prisoners, to better combat the risk and spread of radicalisation and to improve working conditions for prison staff; recalls that the Commission recently mentioned the possibility of drawing on the Structural Funds of the European Union;

Reaffirms the importance of ensuring that children in prison are treated in a manner that takes into account their best interests, including being kept separate from adults and having the right to maintain contact with their families, unless a court decision rules otherwise; recalls that Directive (EU) 2016/800 on procedural safeguards for children includes a preference for alternative measures;
