Recital 2 a (new)
(2a) Notwithstanding the right to apply retaliatory measures having been recognised in a dispute settlement, the Union may consider not to apply those measures in the case a third country is seeking to pursue legitimate public purposes, such as health or environmental protection, through the measure that has been declared illegal.

(9a) When assessing the Union's general interest in respect of the adoption of enforcement measures, while pursuing a balanced approach, the Commission should take particular account of the situation of the Union's producers. The Commission will inform the European Parliament of its determination of the Union's general interest on a case-by-case basis.

The Commission shall seek information and views regarding the Union's economic interests in specific products or sectors, in the application of this Regulation, through a notice in the Official Journal of the European Union or other suitable public communication meanssetting the modalities for submitting information and the deadlines by which submissions are to be made.

Article 9 – paragraph 2
2. Information received pursuant to this Regulation shall be used only for the purpose for which it was requested. As soon as the information gathering has reached the deadline, the Commission shall inform the European Parliament, with no delay, of how it intends to take account of the information gathered when determining the Union's general interest.

6. Paragraphs 2 to 5 shall not preclude the disclosure of general information by the Union authorities. Such disclosure must take into accountThe Commission shall make available to the public a summary outlining how the Union's economic interest has been applied on a case-by-case basis. Such disclosure will be compatible with the legitimate interest of the parties concerned in not having their business secrets divulged.
