InviNotes the Commission to propose's intention to adopt a legal framework foron services concessions that would ensure transparency, effective judicial protection for bidders and legal certainty; ; recalls that the principles deriving from the Treaty on the Functioning of the European Union, such as transparency, equal treatment, proportionality, non-discrimination and mutual recognition, already apply to service concessions; recalls the European Parliament's position on an initiative on service concessions as stated in the Resolution on New developments in public procurement of 18th May 2010, according to which a legislative initiative would be justified only on the grounds of distortions in the functioning of the internal market, and that such a legislative initiative appears to be unnecessary given the fact that such distortions have not so far been identified;
