CRecalls furthermore for the removal of the options for grantingthe findings of the Commission staff working document on the REFIT Evaluation of the Environmental Liability Directive (SWD/2016/0121 final), which underline that strict liability for hazardous activities is economically more efficient than fault liability; notes, however, that permit defence and state-of-the -art defences in order can provide important investor create a level playing field and promote the polluter pays principleertainty for planning, research and development (R&D), and financial security for potential liabilities under the ELD; recommends that a further limitation of options for granting permit defence and state-of-the art defences be given due consideration in a future review of the ELD;
