(7) In the light of the Commission report and the impact assessment, self-employed drivers should be excluded from the scope of Directive 2002/15/ECGiven that the provisions of Directive 2002/15/EC have applied to self-employed drivers only from 23 March 2009, it is too early for a definitive assessment of the consequences of extending the provisions thereof to self-employed drivers. A Commission report on the implementation of the directive in the Member States should therefore be submitted to a committee of self-employed drivers to whom the directive applies.

1. The Directive shall apply to mobile workers, as defined in Article 3(d) of this Directive, employed by undertakings established in a Member State, participating in road transport activities covered by Regulation (EC) No 561/2006 or, failing that, by the AETR Agreement. This Directive shall also apply to mobile workers as defined in the second sentence of Article 3(d). self- employed drivers as defined in Article 3(e). At the latest three years after 23 March 2009, the Commission shall submit to the European Parliament and the Council a report on the effects of extending the scope of the directive to self-employed drivers in terms of road safety, competition, the way in which the profession is structured and social aspects. The situation in each Member State regarding the structure of the transport sector and working conditions for those employed in road transport shall be examined. On the basis of the report, the Commission shall submit a proposal seeking either to lay down conditions for extending the scope of this directive to self-employed drivers applicable to those who do not carry out road transport operations in other Member States and who are for objective reasons subject to local restrictions, for example remote location, large internal distances and particularly keen competition, or to exclude self-employed drivers from the scope of this directive.
