(5a) The European Union should consider setting up a public European rating agency, the main purpose of which would be to produce independent and impartial ratings without being influenced or restricted by commercial considerations; the agency should produce a mandatory second rating in response to every rating produced by a rating agency registered, and operating, in the European Union.

(11) In order to effectively carry out its duties, the European Securities and Markets Authority should have the right to request all necessary information directly from financial market participants. Member States' authorities should be obliged to assist the European Securities and Markets Authority in enforcing such requests and should ensure that the requisite information can be made available without delay.
