(20) Considering the specially vulnerable situation of third-country national seasonal workers and the temporary nature of their assignment, there is a need to define clearly the working conditions applicable to such workers in order to ensure legal certainty by referring such conditions to generally binding instruments providing effective protection of the rights of third- country seasonal workers and abiding by the principle of same pay for the same work in the same place, such as law or universally applicable collective agreements.

Member States shall require employers of seasonal workers to provide evidence that the seasonal worker will benefit from accommodation that ensures an decent, adequate standard of living. If seasonal workers are required to pay rent for such accommodation, its cost shall not be excessive in relation to their remuneration.
