Details

PURPOSE : to freeze the funds belonging to certain persons indicted by the International Criminal Tribunal for the former Yugoslavia (ICTY).

LEGISLATIVE ACT : Council Regulation 1763/2004/EC imposing certain restrictive measures in support of effective implementation of the mandate of the International Criminal Tribunal for the former Yugoslavia (ICTY).

CONTENT : On 28 August 2003, UN Security Council Resolution 1503 (2003) called on the ICTY to complete all work in 2010 and on all States to intensify cooperation with and render all necessary assistance to the ICTY, particularly to bring all fugitive indictees to the ICTY.

Common Position 2004/694/CFSP stipulates that certain funds and economic resources should be frozen in support of effective implementation of the mandate of the ICTY. These additional restrictive measures should be used so as to control all dealings with funds and economic resources owned by persons indicted by the ICTY who are still at large and to ban any support they might receive from within the Community.

In support of the mandate of the ICTY, this Regulation provides that all funds and economic resources belonging to, or owned or held by, natural persons indicted by the ICTY, and listed in Annex I, shall be frozen. The persons listed are as follows:

Ante GOTOVINA. Date of birth: 12 October 1955. Place of birth: island of Pasman, Zadar, Republic of Croatia.

Radovan KARADŽIĆ. Date of birth: 19 June 1945. Place of birth: Savnik, Serbia and Montenegro. Ratko MLADIĆ. Date of birth: 12 March 1942. Place of birth: Kalinovik, Bosnia and Herzegovina.

The Commission is empowered to amend the Annexes to this Regulation.

PURPOSE : to impose restrictive measures in support of the International Criminal Tribunal for the former Yugoslavia (ICTY).

PROPOSED ACT : Council Regulation.

CONTENT : the Commission is proposing this Regulation based on two developments. Firstly, in 2004 the Council reached a Common Position on further restrictive measures to prevent the entry into, or transit through their territories, of certain persons who are engaged in activities which help persons at large to evade justice for crimes which the ICTY has indicted them. Anyone involved in obstructing the ICTY's mandate is included in this Common Position. Within this context the Council requested the Commission to prepare a Regulation on the freezing of certain funds and economic resources relating to those covered by the Common Position. Secondly, the UN Security Council requested all States to intensify co-operation and assistance to the ICTY and in particular to help bring all fugitive inductees to the ICTY.

Based on these two developments, the Commission proposes to adopt legislation whereby persons, groups and entities, whose funds and economic resources are to be frozen, are not necessarily part of a regime. Such a move would help preserve international security and peace. The position of those covered would be similar to that of the persons, groups and entities whose funds and economic resources have been frozen because of their involvement in international terrorism. Further, the proposed provisions are in line with the recent Regulation in respect of Zimbabwe.

Finally, in order to prevent funds and economic resources from being moved, the Commission asks for the contents not be disclosed to the public prior to the Regulation being approved by the Council and published in the Official Journal of the European Union.
