PURPOSE: to introduce temporary measures for the recruitment of officials of the European Communities.
LEGISLATIVE ACT: Council Regulation 1760/2006/EC, Euratom introducing, on the occasion of the accession of Bulgaria and Romania to the EU, special temporary measures for recruitment of officials of the European Communities.
CONTENT: special, temporary, measures need to be adopted that depart from the Staff Regulations of Officials of the European Communities due to the accession of Bulgaria and Romania to the EU. In view of the acceding countries’ size the temporary measures will apply until 31 December 2011.
This Regulation states that:
- Vacant posts may be filled after the actual date of accession of Romania and Bulgaria until 31 December 2011 through the appointment of Bulgarian and Romania nationals within the limit of allotted posts and taking account of budgetary discussions.
- Appointments will be made: for all grades, after the actual date of accession. Appointments will be made following a competitive entrance exam and on the basis of qualifications and tests. The competitive tests will not apply to senior positions such as Directors-Generals or their equivalent in grade AD 16 or AD 15 and Directors or their equivalent in grade AD 15 or AD 14.
ENTRY INTO FORCE: 2 December 2006.
The European Parliament adopted the resolution drafted by Giuseppe GARGANI (EPP-ED, IT), approving the proposal introducing, on the occasion of the accession of Bulgaria and Romania, special temporary measures for recruitment of officials of the European Communities.
The committee adopted the report by its chairman, Giuseppe GARGANI (EPP-ED, IT), approving unamended - under the consultation procedure - the proposed regulation introducing, on the occasion of the accession of Bulgaria and Romania, special temporary measures for recruitment of officials of the European Communities.
The Court of Auditors gave its opinion (3/2006), as requested by the Council, on a proposal for a Council Regulation introducing, on the occasion of the accession of Bulgaria and Romania, special temporary measures for recruitment of officials of the European Communities.
To recall, the purpose of the proposal is to temporarily derogate, for the recruitment of officials from the new Member States, from the relevant provisions of the Staff Regulations concerning recruitment.
The Court examined the proposal and stated that no comments were to be made.
PURPOSE : to introduce special temporary measures for the recruitment of officials of the European Communities.
PROPOSED ACT : Council Regulation.
CONTENT : on the occasion of the forthcoming accession of Bulgaria and Romania special temporary measures should be adopted that depart from the Staff Regulations of Officials of the European Communities (Staff Regulations). Give the relative sizes of the countries acceding and the number of persons potentially involved these, albeit temporary measures should remain in force for a substantial period.
The main features of the proposal are:
§ the derogation from the Staff Regulations is proposed to last until 31 December 2011;
§ the Regulation foresees the organisation of competitions for the selection of officials from Bulgaria and Romania on a national basis;
§ competitions for Bulgarian and Romanian nationals may be held, and lists of successful candidates drawn up, before the accession of these countries to the Union. A country must have joined the Union before its nationals may be appointed as officials to a post with the Institutions;
§ there is a possibility for Institutions to derogate from the requirement to advertise vacant posts within the Institutions. The Institutions may, however, give publicity to vacant posts if they so wish.
Lastly, each Institution will determine the number of officials from the candidate countries to be recruited under the provisions of this derogation Regulation.
