PURPOSE: codification of Council Directive 77/504/EEC on pure-bred breeding animals of the bovine species.

LEGISLATIVE ACT: Directive 2009/157/EC on pure-bred breeding animals of the bovine species (codified version).

CONTENT: the purpose of this Directive is to undertake a codification of Council Directive 77/504/EEC of 25 July 1977 on pure-bred breeding animals of the bovine species. The new Directive will supersede the various acts incorporated in it. It fully preserves the content of the acts being codified and hence does no more than bringing them together with only such formal amendments as are required by the codification exercise itself.

ENTRY INTO FORCE: 30/12/2009. The Directive is applicable from 02/01/2010.

The European Parliament adopted by 633 votes to 13, with 9 abstentions, a legislative resolution approving, under the consultation procedure, the amended proposal for a Council directive on pure-bred breeding animals of the bovine species (codified version).

The text was approved in accordance with the opinion of Consultative Working Party, consisting of the legal services of the European Parliament, the Council and the Commission, which confirmed that the proposal is a straightforward codification of existing texts, without any change in their substance.

The Committee on Legal Affairs adopted the report by Lidia Joanna GERINGER de OEDENBERG (S-D, PL) approving, under the consultation procedure, the proposal for a Council Directive on pure-bred breeding animals of the bovine species (codified version). The proposal was approved as adapted to the recommendations of the Consultative Working Party of the legal services of the European Parliament, the Council and the Commission.

Examination of the proposal has enabled the Consultative Working Party to conclude, without dissent, that the proposal is a straightforward codification of existing texts, without any change in their substance.

On 1 December 2006, the Commission presented a proposal for a Council Directive codifying Council Directive 77/504/EEC of 25 July 1977 on pure-bred breeding animals of the bovine species.

In its opinion of 20 December 2006 the Consultative Working Party of the legal services set up under the Interinstitutional Agreement on an accelerated working method for official codification of legislative texts stated that the proposal does indeed confine itself to straightforward codification, without any substantive changes to the acts covered by it.

Having regard to the amendment adopted in respect of the proposal and in view of the work already carried out in the Council thereon, the Commission has decided to present an amended proposal for codification of the Directive in question.

The amendments are of a technical nature, and include the re-numbering of clauses and a provision that Member States shall keep up to date a list of bodies which are officially recognised for the purpose of maintaining or establishing herd-books and make it available to the other Member States and to the public.

The European Parliament is consulted again on this amended proposal (reconsultation).

The European Parliament adopted the resolution drafted by Hans-Peter MAYER (EPP-ED, D) and approved the Commission’s proposal on pure-bred breeding animals of the bovine species (codified version). The report was adopted by 626 votes in favour to 12 against with 14 abstentions.
