LEGISLATIVE ACT: Regulation (EC) No 592/2008 of the European Parliament and of the Council amending Council Regulation (EEC) No 1408/71 on the application of social security schemes to employed persons, to self-employed persons and to members of their families moving within the Community
CONTENT: this Regulation amends rules for the application of social security schemes to workers and members of their families moving within the EU. The Regulation updates regulation 1408/71 in order to take account of recent changes in the national legislations of Austria, Denmark, France, Germany, Hungary, Ireland, the Netherlands and Poland. Accordingly, Annexes I, II, IIa, III, IV, VI and VIII to Regulation (EEC) No 1408/71 are amended in accordance with the Annex to this Regulation.
ENTRY INTO FORCE: 07/07/2008.
The European Parliament adopted a legislative resolution based on the report drafted by Csaba ŐRY (EPP-ED, HU) amending, under the 1 st reading of the codecision procedure, the proposal for a regulation amending Council Regulation (EEC) No 1408/71 on the application of social security schemes to employed persons, to self-employed persons and to members of their families moving within the Community. Parliament made a number of technical amendments that seek to simplify the proposal, correct errors and omissions and update the annexes to Regulation 1408/71. The amendments reflect changes to the titles of a number of social security payments and correct a typographical error in the proposal.
The Committee on Employment and Social Affairs adopted the report by Csaba ŐRY (EPP-ED, HU) amending, under the 1 st reading of the codecision procedure, the proposal for a regulation of the European Parliament and of the Council amending Council Regulation (EEC) No 1408/71 on the application of social security schemes to employed persons, to self-employed persons and to members of their families moving within the Community. A number of technical amendments have been made by the committee that seek to simplify the proposal, correct errors and omissions and update the annexes to Regulation 1408/71. The amendments take account of changes to the titles of a number of social security payments and corrects a typographical error in the proposal.
Pending the European Parliament's opinion at first reading, the Council agreed on a general approach on a draft Regulation amending Regulation (EEC) No 1408/71 on the application of the national social security schemes to persons moving within the Community.
The draft Regulation aims to update and amend the references in certain Annexes to Regulation (EEC) No 1408/71, to take account of recent changes in national legislation. Similar exercises have been undertaken at more or less annual intervals. This update is intended to be the last one for Regulation (EEC) No 1408/71.

In 2004, the institutions approved a new Regulation: Regulation (EC) 883/2004, which simplifies and updates the 1971 Regulation. See COD/1998/0360 . Indeed, the 2004 Regulation will apply once its implementing Regulation has come into force.
CONTENT: the purpose of this proposal is to update and amend the references in certain annexes to the 1971 Regulation because the national legislation to which they refer has been amended. This regular update is intended to be the last one for Regulation (EEC) No 1408/71 before the application of the two new Regulations.
Prior to presenting the proposal, the Commission consulted the Member States on changes made in their national legislation to social security schemes. Member States frequently amend their national social security legislation and as a result, references made to national law in EU legislation becomes outdated thereby creating legal uncertainty. Not only does this impact upon EU citizens moving with the EU it also makes the work of national social security institutions more complicated.
In terms of workload or costs, the proposal will make no particular difference to the existing situation.
