PURPOSE: final adoption of amending budget 8/2009.

LEGISLATIVE ACT: 2009/803/EC, Euratom.

CONTENT: the European Parliament has definitively adopted amending budget 8/2009 of the European Union, in accordance with its resolution of 15 September (please refer to the summary of the resolution).

This amending budget covers the following elements:

an increase in commitment appropriations for animal disease eradication and monitoring programmes and monitoring of the physical conditions of animals that could pose a public health risk linked to an external factor, the creation of a budget item "Operation of the high-flux reactor (HFR) Supplementary HFR programmes", the creation of a budget item European Police Office – transition costs, a reinforcement of the Community subsidy to EUROJUST, modifications to the establishment plan of OLAF.

As regards the financing of the creation of the Europol budget item, the amending budget confirms the decision of the European Parliament, the Council and the Commission to provide EUR 1 250 000 in order to cover transition costs in the year 2009. The creation of this budget line is neutral in terms of the budget since the equivalent appropriations will be redeployed from article 18 05 09 Prevention of and fight against crime.

Details

The European Parliament adopted by 594 votes to 27, with 30 abstentions, a resolution approving, unamended, the draft amending budget No 8/2009 of the European Union for the financial year 2009.

Parliament recalls that the draft amending budget No 8 covers:

an increase in commitment appropriations for animal disease eradication and monitoring programmes and monitoring of the physical conditions of animals that could pose a public health risk linked to an external factor, the creation of a budget item "Operation of the high-flux reactor (HFR) Supplementary HFR programmes", the creation of a budget item European Police Office – transition costs, a reinforcement of the Community subsidy to EUROJUST, modifications to the establishment plan of OLAF.

Parliament approved this draft amending budget, taking into account the results of the interinstitutional trilogue held on 1st September namely on the financing of the integration of EUROPOL in the EU Budget.

This trialogue concluded that the financing of Europol as a Community agency can be secured within the agreed expenditure ceiling of sub-heading 3a of the multiannual financial framework (MFF) for the period 2007-2013. The annual amount will be decided in the framework of each annual budgetary procedure.

Moreover, the Commission, the European Parliament and the Council accept the transition costs of EUR 1.25 million in the year 2009, covered by redeployments within the abovementioned sub-heading.

The European Parliament and the Council ask the Commission to present as quickly as possible draft common guidelines to implement Point 47 of the IIA (according to which the two arms of the budget authority should agree to the financing of a Community agency, on the basis of information from the Commission on the budget implications of this funding under the corresponding heading of the Union’s budget).

On 3 July, the Commission forwarded to the Council preliminary draft amending budget (PDAB) No. 8 to the general budget for 2009, which contains the following elements:

increase of EUR 49 340 000 in commitment appropriations for item 17 04 01 01 "Animal disease eradication and monitoring programmes and monitoring of the physical conditions of animals that could pose a public health risk linked to an external factor - new measures" in order to finance an emergency vaccination campaign to rapidly prevent the spread of the bluetongue disease outbreaks occurred since 2006; the creation of item 10 04 04 02 "Operation of the high-flux reactor (HFR) - Supplementary HFR programmes (2009 to 2011) with a "p.m." for c/a and p/a as a budgetary structure for the contributions of the Member States participating in the research programme in accordance with Council Decision 2009/410/Euratom on the adoption of a supplementary research programme to be implemented by the Joint Research Centre for the European Atomic Energy Community;

reinforcement of the Community subsidy to EUROJUST by an amount of EUR 3 900 000 in c/a and p/a. The amount of EUR 1 600 000 in c/a is covered by assigned revenue originating from the EUROJUST surplus from 2008 and the remaining commitments of EUR 2 300 000 are deducted from the margin of heading 3a, of which EUR 1 390 000 is entered in item 18 06 04 01 and EUR 910 000 in item 18 06 04 02. The corresponding amounts in p/a are drawn from the line 18 06 07 "Civil justice" by an internal transfer and entered in items 18 06 04 01 and 18 06 04 02; the creation of item 18 05 02 03 "European Police Office - Transition costs" with an amount of EUR 1 250 000 in c/a and p/a as a budgetary structure for a part of the expenditure to be funded from the Community budget in accordance with the Council Decision No 2009/371/JHA of 6 April 2009 establishing the European Police Office (Europol). The commitments and payments are mobilised from the line 18 05 09 "Prevention of and fight against crime" by an internal transfer; temporary modification of the establishment plan of OLAF by increasing the number of AD 11 posts by 12 in order to allow for OLAF to fill these posts with successful candidates from external competitions which are currently OLAF temporary agents. The purpose of this budgetary neutral adaptation of OLAF's establishment plan, which will disappear in the 2010 budget, is to avoid massive departures and loss of important know-how among the OLAF staff.

The changes proposed in PDAB No. 8/2009 do not affect the general statement of revenue for the 2009 budget.

On 7 September 2009, the Council established draft amending budget No. 8 for the financial year 2009, as submitted by the Commission in its preliminary draft amending budget No. 8 and as set out in the technical annex to the explanatory memorandum of this text (see Council Doc. 12952/09 ADD 1 ).

The Committee on Budgets adopted the report drawn up by Jutta HAUG (S-D, DE) on Draft amending budget No 8/2009 of the European Union for the financial year 2009.

The committee recalls that the draft amending budget No 8 covers:

an increase in commitment appropriations for animal disease eradication and monitoring programmes and monitoring of the physical conditions of animals that could pose a public health risk linked to an external factor, the creation of a budget item "Operation of the high-flux reactor (HFR) Supplementary HFR programmes", the creation of a budget item European Police Office – transition costs, a reinforcement of the Community subsidy to EUROJUST, modifications to the establishment plan of OLAF.

MEPs approved, unamended, the draft amending budget No 8/2009, taking into account the results of the interinstitutional trilogue held on 1st September according to the provisions of point 47 of the IIA, namely on the financing of the integration of EUROPOL in the EU Budget.

This trialogue concluded that, on the basis of the information transmitted by the Commission in its financial programming, the European Parliament and the Council note that the financing of Europol as a Community agency can be secured within the agreed expenditure ceiling of sub-heading 3a of the multiannual financial framework (MFF) for the period 2007-2013. PURPOSE: to present Preliminary Draft Amending Budget (PDAB) 8/2009.

CONTENT: PDAB No 8 for the year 2009 covers the following elements:

bluetongue disease : an increase of EUR 49 340 000 in commitment appropriations for budget item 17 04 01 01 Animal disease eradication and monitoring programmes and monitoring of the physical conditions of animals that could pose a public health risk linked to an external factor – New measures. In this supplementary programme it is indicated that the contribution will come from three participating Member States, namely The Netherlands, France and Belgium, as the financial contributions made to the general budget of the European Union by way of assigned revenue. The Commission will not contribute to the operational cost of the HFR with funds from its budget. However, the Commission needs to create an "entry point" for this programme with a token entry "p.m." on the new budget item 10 04 04 02 Operation of the high-flux reactor (HFR) — Supplementary HFR programmes (2009 to 2011); Europol : the creation of budget item 18 05 02 03 European Police Office – transition costs, to be endowed with an amount of EUR 1 250 000 in commitment and payment appropriations. The financing of these costs will have no impact on the margin of heading 3a, since both commitment and payment appropriations will be redeployed from article 18 05 09 Prevention of and fight against crime; Eurojust : a reinforcement of the Community subsidy to Eurojust by EUR 3 900 000 , of which it is proposed that EUR 1 600 000 be covered by assigned revenue stemming from the recovery of the EUROJUST surplus for the financial year 2008. Thus, the request for fresh commitment appropriations in this amending budget amounts to EUR 2 300 000. The corresponding payment appropriations will come from article 18 06 07 Civil Justice programme. This will bring the Community subsidy for 2009 from EUR 22.5 million to EUR 26.4 million. The proposed reinforcement is broken down by Title in the proposal; OLAF : modifications to the establishment plan of OLAF, without additional financial provisions.

The net financial impact of this amending budget is EUR 51 640 000 in fresh commitments , with no new request for payment appropriations.

This increase is intended to strengthen the budget for the eradication of bluetongue disease; supplementary high-flux reactor programmes : the creation of budget item 10 04 04 02 Operation of the high-flux reactor (HFR) — Supplementary HFR programmes (2009 to 2011), with a "p.m.". In this supplementary programme it is indicated that the contribution will come from three participating Member States, namely The Netherlands, France and Belgium, as the financial contributions made to the general budget of the European Union by way of assigned revenue. The Commission will not contribute to the operational cost of the HFR with funds from its budget. However, the Commission needs to create an "entry point" for this programme with a token entry "p.m." on the new budget item 10 04 04 02 Operation of the high-flux reactor (HFR) — Supplementary HFR programmes (2009 to 2011); Europol : the creation of budget item 18 05 02 03 European Police Office – transition costs, to be endowed with an amount of EUR 1 250 000 in commitment and payment appropriations. The financing of these costs will have no impact on the margin of heading 3a, since both commitment and payment appropriations will be redeployed from article 18 05 09 Prevention of and fight against crime; Eurojust : a reinforcement of the Community subsidy to Eurojust by EUR 3 900 000 , of which it is proposed that EUR 1 600 000 be covered by assigned revenue stemming from the recovery of the EUROJUST surplus for the financial year 2008. Thus, the request for fresh commitment appropriations in this amending budget amounts to EUR 2 300 000. The corresponding payment appropriations will come from article 18 06 07 Civil Justice programme. This will bring the Community subsidy for 2009 from EUR 22.5 million to EUR 26.4 million. The proposed reinforcement is broken down by Title in the proposal; OLAF : modifications to the establishment plan of OLAF, without additional financial provisions. The net financial impact of this amending budget is EUR 51 640 000 in fresh commitments , with no new request for payment appropriations.
