Details

PURPOSE: to conclude a Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part, to take account of the accession of Croatia to the European Union.

NON-LEGISLATIVE ACT: Council Decision 2014/320/EU on the conclusion, on behalf of the European Union and its Member States, of the Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and the Republic of Albania, of the other part, to take account of the accession of the Republic of Croatia to the European Union.

BACKGROUND: in accordance with a Council Decision, the Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part , to take account of the accession of Croatia to the European Union has been signed, subject to its conclusion.

The conclusion of the Protocol is subject to a separate procedure as regards matters falling within the competence of the European Atomic Energy Community.

The Protocol should be approved on behalf of the European Union.

CONTENT: by means of this Decision, the Council approves, on behalf of the European Union, with the consent of the European Parliament, the Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and the Republic of Albania, of the other part, to take account of the accession of the Republic of Croatia to the European Union.

Most of the provisions relate to the new Albanian tariff concessions for agricultural primary products originating in the Community and on rules of origin.

ENTRY INTO FORCE: the decision enters into force on 12.05.2014. The protocol applies provisionally from 01.07.2013.

Details

The European Parliament adopted by 496 votes to 21, with 14 abstentions, a legislative resolution on the draft Council decision on the conclusion, on behalf of the European Union and its Member States, of the Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part, to take account of the accession of Croatia to the European Union.

Parliament gave its consent to the conclusion of the Agreement.

The Committee on Foreign Affairs adopted, under the simplified procedure, the recommendation by Nikola VULJANIĆ (GUE/NGL, HR) in which it called on the European Parliament to give its consent to the draft Council decision on the conclusion, on behalf of the European Union and its Member States, of the Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part, to take account of the accession of Croatia to the European Union.

BACKGROUND: in accordance with a Council Decision, the Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part , to take account of the accession of Croatia to the European Union has been signed, subject to its conclusion.

It is now necessary to conclude the Protocol on behalf of the European Union.

LEGAL BASIS: Article 217, in conjunction with Article 218(6)(a)(i) and the second subparagraph of Article 218(8) of the Treaty on the Functioning of the European Union (TFEU) and the Act of Accession of Croatia.

CONTENT: under this proposal decision, the Council is invited to approve, on behalf of the European Union and its Member States, the Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part, to take account of the accession of Croatia to the European Union.

N.B.: the conclusion of the Protocol is subject to a separate procedure as regards matters falling within the competence of the European Atomic Energy Community.

Details

BACKGROUND: on 24 September 2012 the Council authorised the Commission to open negotiations with Albania in order to conclude a Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part , to take account of the accession of Croatia to the European Union.

These negotiations took place on 19 November 2012 and on 10 January 2013. Following further technical clarifications and correspondence, the Albanian authorities signalled their agreement with the draft Protocol proposed by the Commission on 18 June 2013.

It is now appropriate to conclude the protocol on behalf of the European Union.

IMPACT ASSESSMENT: no impact assessment was undertaken.

LEGAL BASIS: Article 217 of the Treaty on the Functioning of the European Union, in conjunction Article 218(6)(a) and the second subparagraph of Article 218(8) thereof.

CONTENT: this proposal invites the Council to adopt a decision approving, on behalf of the European Union, the Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part, to take account of the accession of Croatia to the European Union.

N.B. for the conclusion of the Protocol on behalf of the European Atomic Energy Community, the Commission proposes that the Council gives its approval, pursuant to the second paragraph of Article 101 of the Treaty establishing the EAEC.

Most of the provisions relate to the new Albanian tariff concessions for agricultural primary products originating in the Community and on rules of origin.

BACKGROUND: on 24 September 2012 the Council authorised the Commission to open negotiations with Albania in order to conclude a Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part , to take account of the accession of Croatia to the European Union. These negotiations took place on 19 November 2012 and on 10 January 2013. Following further technical clarifications and correspondence, the Albanian authorities signalled their agreement with the draft Protocol proposed by the Commission on 18 June 2013. It is now appropriate to conclude the protocol on behalf of the European Union. IMPACT ASSESSMENT: no impact assessment was undertaken. LEGAL BASIS: Article 217 of the Treaty on the Functioning of the European Union, in conjunction Article 218(6)(a) and the second subparagraph of Article 218(8) thereof. CONTENT: this proposal invites the Council to adopt a decision approving, on behalf of the European Union, the Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part, to take account of the accession of Croatia to the European Union. N.B. for the conclusion of the Protocol on behalf of the European Atomic Energy Community, the Commission proposes that the Council gives its approval, pursuant to the second paragraph of Article 101 of the Treaty establishing the EAEC.     LEGAL BASIS: Article 217 of the Treaty on the Functioning of the European Union, in conjunction Article 218(6)(a) and the second subparagraph of Article 218(8) thereof.

    CONTENT: this proposal invites the Council to adopt a decision approving, on behalf of the European Union, the Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part, to take account of the accession of Croatia to the European Union.

    N.B. for the conclusion of the Protocol on behalf of the European Atomic Energy Community, the Commission proposes that the Council gives its approval, pursuant to the second paragraph of Article 101 of the Treaty establishing the EAEC.

    Most of the provisions relate to the new Albanian tariff concessions for agricultural primary products originating in the Community and on rules of origin.

  • PURPOSE: to conclude a Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part, to take account of the accession of Croatia to the European Union.

    PROPOSED ACT: Council Decision.

    ROLE OF THE EUROPEAN PARLIAMENT: Council may adopt the act only if Parliament has given its consent to the act.

    BACKGROUND: on 24 September 2012 the Council authorised the Commission to open negotiations with Albania in order to conclude a Protocol to the Stabilisation and Association Agreement between the European Communities and their Member States, of the one part, and Albania, of the other part, to take account of the accession of Croatia to the European Union.

    These negotiations took place on 19 November 2012 and on 10 January 2013. Following further technical clarifications and correspondence, the Albanian authorities signalled their agreement with the draft Protocol proposed by the Commission on 18 June 2013.

    It is now appropriate to conclude the protocol on behalf of the European Union.

    IMPACT ASSESSMENT: no impact assessment was undertaken.
