The European Parliament decided to waive the parliamentary immunity of Jürgen CREUTZMANN (ALDE, DE).

The request for waiver of immunity comes from the Chief Public Prosecutor of Frankenthal (Germany) in connection with launching investigative proceedings concerning an alleged offence committed by Jürgen CREUTZMANN. The request relates to proceedings concerning an alleged offence of causing bodily harm by negligence under Section 229 of the German Criminal Code.

Under Article 9 of the Protocol on the Privileges and Immunities of the European Union, Members of the European Parliament enjoy in the territory of their own State the immunities accorded to members of their parliament. It is appropriate, in this case, to refer to Article 46(2) of the German Basic Law (Grundgesetz), whereby a Member may not be called to account for a punishable offence without the permission of Parliament unless apprehended while committing the offence or in the course of the following day. It is, accordingly, necessary to waive Jürgen CREUTZMANN’s immunity.

In order to enable the German authorities to conduct the necessary investigations and to take legal action against Jürgen CREUTZMANN, Parliament has therefore decided to waive his immunity.

The Committee on Legal Affairs unanimously adopted the report by Francesco Enrico SPERONI (EFD, IT), and called on the European Parliament to waive the immunity of Jürgen CREUTZMANN (ALDE, DE).

The request for waiver of immunity comes from the Chief Public Prosecutor of Frankenthal (Germany) in connection with launching investigative proceedings concerning an alleged offence committed by Jürgen CREUTZMANN.
