PURPOSE: to protect health and safety of workers in the predominantly cross-border sector of inland waterway transport.

NON LEGISLATIVE ACT: Council Directive 2014/112/EU implementing the European Agreement concerning certain aspects of the organisation of working time in inland waterway transport, concluded by the European Barge Union (EBU), the European Skippers Organisation (ESO) and the European Transport Workers' Federation (ETF)

CONTENT: the Directive implements the European Agreement concerning certain aspects of the organisation of working time in inland waterway transport , concluded on 15 February 2012 by the European Barge Union (EBU), the European Skippers Organisation (ESO) and the European Transport Workers' Federation (ETF).

The agreement shall apply to mobile workers employed as members of the navigation personnel (crew members) or in another function (shipboard personnel) on board a craft operated within the territory of a Member State in the commercial inland waterway transport sector

The Agreement sets out minimum standards regarding: (i) working time and reference period; (ii) daily and weekly working time; (iii) working days and rest days; (iv) seasonal work on passenger vessels (v) rest periods; (vi) breaks; (vii) maximum working time during night time; (viii) annual leave; (ix) protection of minors; (x) emergency situations; (xi) health assessment; (xii) safety and health protection.

Member States are allowed to maintain or introduce equivalent or more favourable provisions than the Agreement. Together with social partners, they may lay down, in the light of changing circumstances, legislative, regulatory or contractual arrangements different from those prevailing at the time of the adoption of the Directive, provided that the minimum requirements are complied with.

ENTRY INTO FORCE: 12.01.2015.

Details

The European Parliament adopted a resolution prepared by its Committee on Employment and Social Affairs on the proposal for a Council directive implementing the European Agreement concluded by the European Barge Union (EBU), the European Skippers Organisation (ESO) and the European Transport Workers’ Federation (ETF) concerning certain aspects of the organisation of working time in inland waterway transport.

Members recalled that the Agreement concluded certain aspects of the organisation of working time in inland waterway transport between the relevant Parties. The Agreement included a joint request for the Commission to implement it by a Council decision on a proposal from the Commission , in accordance with Article 155(2) TFEU. In this regard, Members recommended the adoption of the future Directive by welcoming the fact that:

Article 155(2) TFEU provides for the possibility of implementing agreements concluded at EU level, at the joint request of the signatory parties, by a Council decision on a proposal from the Commission; Article 155(1) TFEU gives the social partners at EU level the possibility, should they so desire, to enter into a dialogue which may lead to contractual relations, including agreements.

In parallel, Members welcomed the fact that the Agreement as concluded by the social partners and the Commission proposal provide only for minimum requirements , leaving the Member States and/or social partners free to adopt measures which are more favourable to workers in the area concerned.
