Statement by the European Parliament on high-speed passenger services The European Parliament points out that Article 11a is a lex specialis, laying down speciallays down rules governing the access of high- speed passenger services to the Union rail infrastructure. It provides that such access is to be subject exclusively to requirements adopted by the regulatory body in accordance with that Article 11(1). As a result of Article 11a, Member States may decide not to limit the access of high-speed passenger services to the Union rail infrastructure under Article 11(1when justified by an economic equilibrium test carried out by the regulatory body on a case-by-case basis, in accordance with Article 11(2) and (3), as well as with the implementing act adopted under Article 11(4).
