Recital 14 a (new)
(14a) The European Climate Law stipulates that carbon sinks include both natural and technological solutions and that solutions such as those based on carbon capture and storage (CCS) and carbon capture and use (CCU) technologies can play a role in achieving the climate-neutrality objective, in particular by stimulating development of Bio-CCS or direct air capture technologies. Member States should therefore be able to use a limited amount of carbon dioxide removal through carbon capture with long-term storage, to achieve their annual emission allowances. To ensure a sufficient ambition in the reduction of emissions, the amount of carbon dioxide removed by carbon capture solutions should be deducted from the total budget of 225 million tonnes of CO2 equivalent to the contribution from net removals established in the European Climate Law.

(3o) The following Article is inserted: 'Article 5a (new) Deduction for carbon capture removals 1. In respect of the years 2026 to 2030, Member States may have certified carbon capture removals on their territory taken into account for the purpose of their compliance with this Regulation. Removals of this kind of deduction to meet their annual emission allowances should not account for more than the total amount as set out in Annex III. Each Member State may apply such removals, within the total budget of Annex III per Member State, between 2026 and 2030. For any Member State applying such removals, the amount of flexibilities available to that Member State under Article 7 shall be reduced by the same amount. The amount of such removals used to meet annual emission allowances in 2030 shall be deducted from the total budget of 225 million tonnes of CO2 equivalent for the contribution from net removals established in Regulation (EU) 2021/1119 of the European Parliament and of the Council. If the flexibilities under Article 7 of this Regulation are used by a Member State, the amount available under that Article for removals shall be reduced by the same amount.'
