(6a) In Article 9, the following paragraph is added: “2a. In 2027 and 2032, if the reviewed greenhouse gas emissions of a Member State exceeds its annual emission allocation for any specific year of the period, taking into account paragraph 2 of this Article and the flexibilities used pursuant to Articles 5, 6 and 7, a financial compensation shall be paid by the Member State concerned for every tonne of CO2 equivalent in excess of its allocation. The compensation shall be calculated as the average of the closing prices of EU ETS allowances for a tonne of CO2 equivalent on the common auction platform in accordance with the procedures laid down in Commission Regulation (EU) No 1031/20101a for the past three years multiplied by a factor of 1,25. Revenue from financial compensation shall constitute external assigned revenue. Half the revenue from any compensation paid shall be assigned to the fund established by Article 10a (8) of Directive 2003/87/EC of the European Parliament and of the Council1b and half to action on Union level towards Climate Change Mitigation and Adaptation as defined by Regulation (EU) 2021/783 of the European Parliament and of the Council1c, establishing a Programme for the Environment and Climate Action (the 'LIFE Programme') for the period of the multiannual financial framework 2021 to 2027, or any successor programme.
