Article 6 a (new)
(5a) The following Article 6a shall be inserted: Article 6a NSA Coordination Body Without prejudice to the role of the Committee, and of existing informal cooperation among NSAs, the Commission shall establish an independent ‘National Supervisory Authority Coordination Body (NCB)’, to which National Authorities nominated or established by States in accordance with Article 4, may belong. The role of this body shall be to advise the Commission on the regulatory aspects of the implementation of the Single European Sky, including aspects related to safety, economics, airspace, the environment and performance. It may also undertake other tasks that may be entrusted to it by the Commission.

1. To improve the performance of air navigation services and network functions in the single European sky, the Commission shall set up a performance scheme recognising that en-route services, terminal services and network functions are different and should be treated as such for performance measuring purposes. 1. Member States shall take all necessary measures in order to ensure the establishment of functional airspace blocks as soon as possible and at the latest by the end of 2012 with a view to achieving maximum capacity and efficiency of the air traffic management networkwhen areas susceptible to the improvement in efficiency and cost that a FAB can bring have been identified within the single European sky and maintaining a high level of safety and contributing to the overall performance of the air transport system and a reduced environmental impact. Member States shall cooperate with each other to the fullest extent possible in order to ensure compliance with this provision.

(ba) charges shall be set per calendar year and cover at least a three year period, up to maximum five years; or, shall set in advance the conditions for determining the maximum level of the unit rate or of the revenue for each year over a period not exceeding five years. These costs or conditions shall be set out in national performance plans in accordance with Article 11 of Regulation 549/2004.

4. The Commission may decide, in accordance with the procedure referred to in Article 5(3) of the framework Regulation, that charges shall be used to finance common projects designed to assist specific categories of airspace users and/or air navigation service providers in order to improve collective air navigation infrastructures, the provision of air navigation services and the use of airspace, in particular those that may be required for the implementation of the ATM Master Plan. Such decisions shall identify the common project and specify in particular the timetable for implementation, the cost to be charged to airspace users and its allocation amongst Member States.deleted

The Commission may, under its own control and responsibility,in accordance with Article 5(3) of Regulation (EC) No 549/2004 entrust to Eurocontrol tasks relating to the execution of the above functions, which do not involve the adoption of binding measures of a general scope or the exercise of political discretion. These tasks shall be executed in an impartial and cost-effective manner; taking into consideration the needs of the whole ATM network and with the full involvement of the airspace users and air navigation service providers.

Member States shall entrust Eurocontrol, subject to appropriate oversight arrangements, with the performance of air traffic flow management as specified in an implementing rule adopted in accordance with the procedure referred to in Article 5(3) of the framework regulation and in conformity with the requirements laid down by the Commission pursuant to Article 9.'
