  La Commission, dans sa proposition modifiée, a repris la plupart des amendements du Parlement moyennant les modifications suivantes : - il est précisé que la directive ne limite pas le droit existant des établissements de crédit hypothécaire dans l'Etat membre d'origine ou dans un autre Etat membre; - clarifie la notion de "techniques" spécifiant les techniques financières; - limitation à sept ans maximum de la dérogation concernant le choix de la devise des opérations de crédit; - prolongation à 7 ans (à partir de l'adoption de la directive) de la période endéans laquelle les Etats membres peuvent limiter les opérations de crédit hypothécaire d'un établissement de crédit national dans les autres Etats membres.

  Le Parlement européen a approuvé la proposition de directive avec les modifications suivantes : - sauvegarde des droits des établissements de crédit hypothécaire dans l'Etat d'origine ou dans un autre Etat membre; - dans l'attente d'une directive spécifique en matière de contrôle, la surveillance sera exercée par l'autorité du pays hôte - possibilité pour l'Etat membre hôte de limiter les opérations de récolte de fonds et de concession de par un établissement de crédit dont le siège est établi dans un autre état.

  La proposition vise à abroger les dispositions de nature juridique et technique qui pourraient empêcher la liberté d'établissement et la libre prestation des services dans le domaine du crédit hypothécaire. Elle intégrerait la directive 77/780/CEE relative à la coordination des dispositions régissant l'accès à l'activité des établissements de crédit et à son exercice. L'objectif de la proposition est de créer un contexte juridique apte à garantir la pratique du crédit suivant la reconnaissance réciproque des techniques financières autorisées dans les différents Etats membres. Pour ne pas fausser les conditions de concurrence les Etats membres devront autoriser les établissements de crédit travaillant dans le même domaine sur leur territoire, à pratiquer des opérations de crédit hypothécaire dans des conditions similaires. Les autorités de surveillance adopteront le principe de la reconnaissance mutuelle des règles appliquées pour évaluer la solidité financière des établissements. La surveillance de toutes les dispositions sera confiée à l'autorité de surveillance du pays d'accueil.
