  La Convention des Nations unies sur les conditions d'immatriculation des navires (devant être ratifiée par les Etats membres entre le 01.05.1986 et le 30.04.1987) vise à assurer ou à renforcer le lien existant entre les Etats et les navires battant leur pavillon, de façon à permettre à ces Etats d'exercer effectivement sur ces navires leur contrôle en matière d'identification et de responsabilité des propriétaires de navires et des exploitants. Tout en se ralliant aux dispositions générales de cette Convention, la Commission considère que certains de ses articles ayant trait : - à la participation des nationaux à la propriété des navires et aux équipages (articles 7 à 9), - au rôle des Etats du pavillon dans la gestion des sociétés propriétaires de navires et des navires (article 10), - aux coentreprises (article 13) doivent être appliquées de manière à éviter un conflit avec les obligations que le traité de Rome entraîne pour ses Etats membres. En d'autres termes, le droit communautaire n'autorise pas les Etats membres de la Communauté à ratifier cette Convention sauf s'ils obtiennent l'inclusion d'une clause rendant celle-ci compatible avec le Traité ou s'ils trouvent une autre solution équivalente. C'est pourquoi, la Commission propose de régler ce problème juridique en permettant aux Etats membres de ratifier cette Convention à la condition impérative qu'ils émettent une résrve commune sur les articles litigieux (articles 8, 9 et 10 de la Convention). Cette réserve précise que lorsqu'un Etat membre donné appliquera ces articles, il le fera dans le respect des obligations qui lui incombent en vertu du traité instituant la Communauté et notamment celles qui établissent l'égalité de traitement entre tous les ressortissants de la Communauté.
