The Council addressed once again the sensitive and difficult issue of the protection of animals in transport. For this purpose it had the Presidency compromise put forward in March together with suggestions from the Commissioner, Mr Fischler. Concluding its discussions, the Council noted that several delegations could agree on certain basic principles that should underpin any future solution, such as the distinction to be made between species, specific requirements for the most delicate animals, adaptation of means of transport to the animals’ physiological needs, and transport by sea. There were still deep disagreements among delegations, especially over journey times, rest periods, watering and feeding intervals, and the continuation of journeys after rest periods. The Council agreed to continue the discussion at its next meeting, when it would try to reach a conclusion on the issue.

During the discussion the Commission made some suggestions for technical improvements to the Presidency compromise, which the Council intends to examine. Winding up, the President appealed to all delegations to make an effort so that the Council could reach a Decision at a future meeting.

In light of Parliament’s opinion, the Commission has amended its original proposal as follows:- the animals are rested, fed and watered and, if necessary, unloaded and given appropriate accommodation. Maximum intervals (in hours) applicable to various types of animals are laid down;- During transport, the animals must receive water and appropriate food and rest at suitable intervals.- All animals shall be rested for at least eight hours whilst receiving food. After 24 hours of journey time (including resting periods), all animals must receive 10 hours of rest.- Lastly, exporters of animals to third countries shall give a written undertaking that the provisions of this Directive will be observed throughout the journey and that arrangements have been made to ensure this compliance.

Secondly, it called for the persons authorised to transport the animals to be qualified. Parliament called for the creation in the Commission of a service with adequate staff with the special task of dealing with the well-being of animals (amendment PPE 147/127/2). �

The purpose of this proposal is to amend Directive No 91/628 concerning the protection of animals during transport, in order to add two new chapters to the annex setting out requirements for the space allocated to the animals, the minimum travelling times and minimum rest periods. It is also proposed that, where reliable scientific evidence is available, the annex be amended and specific requirements incorporated for clearance in vehicles and scheduled feeding and watering intervals for certain types of animals. �
