The European Parliament approved this proposal for a directive with the following amendments: - Parliament clarified that the legal basis of this text should include both Article 213 and Article 75; - the compilation of statistics should result in as little extra burden as possible for respondents; - the directive should not apply to vessels used for public service purposes; - respondents were authorised to supply data in accordance with agreements made within the context of the simplification of trade procedures, the ISO, the CEN and international customs regulations; - the results should no longer be transmitted in the form of data files, as recommended by the Commission; - the first transmission of data should cover the first quarter of 1996 instead of 1995 as suggested by the Commission. Similarly, the directive should be implemented by the Member States no later than 1 January 1996 and not 1 January 1995; - every three years the Commission should submit a report to the budgetary authority on the implementation of the directive; - the EP added "the suspension of the collection of individual data on passenger transport" to the arrangements for implementing the directive laid down by the Commission in consultation with the Statistical Programme Committee; - modifications were made to the decision-making procedure of the committee assisting the Commission. In the annexes, Parliament added statistical variables to the list proposed by the Commission (final port of destination of the cargo, port of origin of the cargo, nationality of the ship operator, gross tonnage of the vessels) and amended certain definitions in the annex devoted to this heading (ship operator, nationality of the ship operator, deadweight tonnage). Finally, Parliament added an Annex Va with a list of ports and description of how the Commission should manage this list. �

The Council noted the stage reached in the discussions on the proposal for a directive on statistical returns in respect of carriage of goods and passengers by sea. Basically, the document proposes that Member States produce statistics on shipping that are harmonised across the different countries and coordinated with existing statistics on the carriage of goods by road, rail and inland waterway. By this means the proposal aims to contribute to the development, follow-up, monitoring and evaluation of the internal shipping market. The Permanent Representatives Committee was instructed to expedite its discussions, in the light of the opinion to be delivered by Parliament, so that the Council could adopt the Directive at its next meeting in June 1995.

1) OBJECTIVE To supply the Community with statistical data on the carriage of goods and passengers by sea that was harmonised and coordinated with other forms of transport so as to help develop and monitor a policy of free and fair competition in the field of the provision of transport services. 2) SUBSTANCE 1. Obligation for the Member States to collect Community statistics on the carriage of goods and passengers calling at ports in their territories. 2. Definition of certain terms contained in the regulation and determination of the scope of the regulation. 3. Rules governing the selection of ports in which statistics would be collected. 4. Collection of data: * obligation to provide for methods for collecting data that would ensure a high level of accuracy with regard to the statistics. * rules on accuracy laid down by the Commission. 5. Processing of results: obligation to provide for methods for processing the statistics gathered in order to obtain comparable statistics guaranteeing a high level of accuracy with regard to the data. 6. Transmission of results: rules governing the transmission of statistical data sets to the Statistical Office of the European Communities. 7. Reports. After collecting data for three years, obligation for the Commission to submit to the Council a report on the experience acquired in the work carried out pursuant to this directive. 8. Dissemination of data: obligation for the Commission to disseminate appropriate statistical data with a periodicity comparable to that of the results transmitted. 9. Transitional period concerning the collection of statistical data on goods. 10. Financial contribution: contribution from the Community during the first three years in which the statistical returns provided for in this directive were made. 11. Rules of implementation: obligation for the Commission to establish these rules, after consultation of the Statistical Programme Committee set up by Council Decision 89/382/EEC, Euratom and in accordance with a procedure laid down in these regulations.
