Details

Under the co­decision procedure with Parliament, the Council adopted the Directive amending - Directive 79/581/EEC on consumer protection in the indication of the prices of foodstuffs, and - Directive 88/314/EEC on consumer protection in the indication of the prices of non­-food products. The aim of the Directive is to postpone for two years full implementation of current Community legislation on the indication of the unit prices of certain pre-­packaged products. Without this ‘postponement’ Directive, the provisions in question would have applied as from 7 June 1995. They had proved extremely complex given the fact that commercial practices vary from one Member State to another. The additional period will therefore be used to prepare a new simplified mechanism for the indication of prices based on a general obligation to indicate both the price and the unit price of all products. The text of the Directive corresponds to that of the common position adopted by the Council on 19 June 1995, which was approved by Parliament at second reading on 20 September 1995.

Commissioner MONTI stated that the Commission could take over Amendments Nos 2, 3 and 4, thus extending the current transitional period by two years instead of four; he proposed that Amendment No 1 be redrafted. It seemed to Mr MONTI that Amendments Nos 5 and 6 anticipated the future system, which had yet to be determined, and should therefore be rejected.

The Economic and Social Committee accepted the proposal of the Commission to postpone the date of application of the Directives by a further four years, from 6 June 1995 to 6 June 1999. It insisted that this date had to be the final and last one, and declared that it would not give its consent to any further postponement beyond this date. It hoped that the Commission’s difficulties would be resolved rapidly and urged the Commission to propose very soon a new, generally acceptable text for the Committee’s Opinion.

  • date: 1995-10-30T00:00:00 type: Act approved by Council, 2nd reading body: CSL summary: Under the co­decision procedure with Parliament, the Council adopted the Directive amending - Directive 79/581/EEC on consumer protection in the indication of the prices of foodstuffs, and - Directive 88/314/EEC on consumer protection in the indication of the prices of non­-food products. The aim of the Directive is to postpone for two years full implementation of current Community legislation on the indication of the unit prices of certain pre-­packaged products. Without this ‘postponement’ Directive, the provisions in question would have applied as from 7 June 1995. They had proved extremely complex given the fact that commercial practices vary from one Member State to another. The additional period will therefore be used to prepare a new simplified mechanism for the indication of prices based on a general obligation to indicate both the price and the unit price of all products. The text of the Directive corresponds to that of the common position adopted by the Council on 19 June 1995, which was approved by Parliament at second reading on 20 September 1995.
