summary
The Council's common position took over four of the five amendments adopted by Parliament, particularly those relating to: - extending by only two years (instead of four) the implementation of the provisions of the two directives to be amended; - the proposal that the Commission should submit before the end of the year a proposal for simplified rules, based on the general obligation to indicate the selling price and the unit price for all products. However, the Council did not accept the amendment calling for the new proposal to provide an exact definition of the term "small retail businesses".

summary
The Commission's amended proposal incorporated the European Parliament's amendments aimed at: - ensuring that the Commission submitted a proposal for simplified rules before the end of the year; - to extend the transitional period by two years instead of four, with a view to speeding up the entry into force of the simplified rules; - to remove the date of 6 June 1995 as the deadline for transposition. The Commission did not take over the amendment calling for a clear and precise definition of the term "small retail businesses".

summary
The European Parliament approved this proposal for a directive with the following amendments: - the EP extended by two years (instead of four, as proposed by the Commission) the transitional period exempting certain Member States from the rules on price indication for specific pre-packaged products; - Parliament also called on the Commission to submit to the EP, before the end of the year, a proposal for simplified rules based on the general obligation to indicate the selling price and the unit price for all products. The proposal should also include an exact definition of "small retail businesses", which were currently exempt from certain provisions of the directives establishing the general principle of price indication.

Debate in Parliament
summary
Commissioner MONTI stated that the Commission could take over Amendments Nos 2, 3 and 4, thus extending the current transitional period by two years instead of four; he proposed that Amendment No 1 be redrafted. It seemed to Mr MONTI that Amendments Nos 5 and 6 anticipated the future system, which had yet to be determined, and should therefore be rejected.

COM(1994)0431
summary
The current provisions on the indication of the price of foodstuffs and non-food products stipulate a general obligation to indicate the selling price of all products, together with the unit price per measure of products sold in bulk or pre-packaged in various sizes. In practice, the application of the second part of these provisions, for which a transitional period applies until 7 June 1995, is causing difficulties both for Member States and economic operators. The current law needs to be simplified but it would appear that the new simplified rules will not be able to enter into force in June 1995. However, because the transitional period provided for under current provisions is due to expire, a proposal needs to be presented, without waiting for precautions to be taken, in order to guarantee the legal security of the current rules and make provision for a reasonable deadline for introducing the new rules. This proposal therefore extends the transitional period for the rules applicable to pre-packaged products of pre-established quantities for a further four years. This does not affect the first part of the current rules or the general obligation to indicate the selling price of products.
