In presenting the background to the proposal for a regulation, which was being applied to Austria because its bilateral agreements, concluded prior to accession, were incompatible with the principle of freedom to provide services, the rapporteur recommended that the common position of the Council be adopted without amendment. Commissioner Van Miert stated that there was a need for Community-wide integration of the inland waterway transport system.

The Council held a policy debate on the proposal for a regulation to introduce Community rules on access to transport between Member States to ensure application of the principles of freedom to provide services within the Community. The Regulation is necessary to ensure freedom to provide services in this area as a consequence of the accession of Austria, which is bound by bilateral conventions with two other Member States, Germany and the Netherlands, as regards inland waterway transport. At the end of the debate the President noted a consensus broadly in favour of the proposal. The Permanent Representatives Committee will continue discussions with a view to the adoption of a common position as soon as the European Parliament has delivered its opinion.

OBJECTIVE: to establish freedom to provide transport services between Member States. CONTENT: 1. Scope of the regulation: the regulation applies to the transport of passengers or goods by inland waterway between and through Member States. 2. Eligibility criteria: in order to effect the transport operations referred to in the regulation, owners of vessels must: * be established in a Member State in accordance with the laws of that state; * be entitled to provide international passenger or goods transport services by inland waterway in that state; * use vessels for the transport operations in question which are registered in a Member State or, if there is no register, which are covered by a certificate of membership of the fleet of a Member State. 3. Special provisions govern the rights of third country carriers under the revised Convention for the Navigation of the Rhine (Mannheim Convention), the Convention on Navigation on the Danube (Belgrade Convention) and the international obligations of the European Community.
