    In its amended proposal the Commission incorporated the amendments put forward by the European Parliament which provided that: - coastal States should have access to real-time data on the vessels which are present in their waters; - the control measures should apply to vessels with a length of more than 15 metres; - vessels carrying out fishing activities in the waters of their own Member State should transmit the report of their fishing effort in accordance with the methods defined by that Member State and approved by the Commission; - measures relating to the identification of non-active fishing tackle are to be adopted in accordance with the procedure laid down in Article 36, and at the latest by 31.12.1996; - the Member State shall temporarily close down the fishery when its quota is used up, without prejudice to the full utilization of its catch quotas and in accordance with the procedure for the re-adjustment of quotas for fishing effort. The other amendments proposed by Parliament were not taken up by the Commission. �

    In adopting the report by Mr James PROVAN (PPE, UK), Parliament approved the proposal while at the same time drawing attention to the following points: - all fisherman operating in the north-east Atlantic and in the Baltic Sea must be subject to the same system of controls; - Sweden and Finland should be fully integrated into the common fisheries policy; - the requirements of the control system must not impose increased administrative costs on the captains of fishing vessels; - a sufficient period of time is needed for introducing the automatic control systems; - coastal States must have access to real-time data on the fishing vessels operating in their waters. Parliament called in particular for vessels over 15 metres in length to be fitted with a satellite monitoring system which is recognized by Community legislation. Such a system should make it possible to keep track of the position and movement of all boats in this category, while at the same time ensuring that the required logbook data were automatically transmitted. This information must be conveyed to the data-processing system operated by the flag Member State and by the Member State responsible for operating the control system. �

    The Council took note of the Commission’s presentation of its proposal for the establishment of a new element of the control system applicable to common fisheries policy and amending Regulation (EC) No 2847/93. The purpose of this proposal is to provide for the implementation, as from 1 January 1996, of the monitoring tools for the management of fish stocks in accordance with the fixing of maximum annual fishing efforts by fishery for each MemberState. The Council instructed the Permanent Representatives Committee to examine the proposal with a view to the adoption of the Regulation, subject to the European Parliament’s opinion, no later than 31 December 1995.

    The Commission proposal aimed to supplement the existing provisions to integrate the measures relating to the control and monitoring of fisheries activities subject to fishing effort limitations. The adoption of these measures should ensure respect for the system for managing the fishing effort which was due to enter into force on 1 January 1996 in a transparent and non-discriminatory manner. As a result, the Commission proposed adding the following provisions to Regulation (EEC) 2847/93: - Control of the movements of Community vessels in fishing grounds: the proposal defined the conditions of application of the system for communicating details of entries and exits from fishing grounds in which fishing effort limitation applied; - The introduction of Community infrastructure for the management of data: in order to facilitate the collection and processing of data concerning the movements of Community vessels in fishing areas, it was proposed that the Member States should agree to establish databases that were accessible to the Commission; - Restrictions on the fishing effort should be managed at both individual and Member State level: . definition of a date in the area and checks to ensure that the number of days spent in a fishing area matched the details in the logbook; . carrying out checks by sampling the fishing activities of vessels exempt from the obligation to keep a logbook. The Member States should also: . complete the registers they had created in accordance with Commission Regulation (EC) No 109/94 concerning the fishing vessel register of the Community so as to incorporate the data contained in the lists of named vessels by fishing areas; . transmit this data to the Commission in electronic form, which would then be accessible to the Member State responsible for monitoring in the waters covered by a fishing area; . record the fishing activities of its vessels for each fishing area; . notify the Commission of the management measures adopted when it was deemed to have exhausted 70% of the fishing effort; . provisionally prohibit access to the fishing area when the authorised fishing effort for that area was reached. On the basis of the information received, the Commission would fix the date on which the maximum fishing effort level of a Member State for a fishing area was deemed to have been reached. Finally, the proposal stipulated that fishing gear, and particularly static gear, should be subject to additional control measures. �
