While stressing that the EU’s dependence on imported energy could increase from the current figure of 50% to around 75% by 2015, the rapporteur recalled the approach which had led to the signing, in September 1995, of the Energy Charter Treaty and Protocol. According to the rapporteur, the Protocol formed a good basis for more exacting environmental protection. However, she regretted that the Treaty and Protocol had no legally binding provisions on environmental protection. She called for new projects and measures to be implemented under the Treaty to be preceded by a compulsory Environmental Impact Assessment. Commissioner Wulf-Mathies pointed out that the Energy Charter was a political declaration of intent without any legally binding force. Indicating that 49 countries (excluding the United States of America) plus the European Union had signed the Treaty to date, the Commissioner highlighted the importance of the Charter’s ratification as, within the European Union, only nine Member States had completed the ratification procedure. Against this background, she highlighted the positive role which the Charter would play in promoting cooperation between East and West in the energy sector.

OBJECTIVES: - to consolidate the initiative and the central role of the European Communities by enabling them to participate fully in the implementation of the Energy Charter Treaty and the Energy Charter Protocol on energy efficiency and related environmental aspects applied by the EC on a provisional basis since they were signed on 17 December 1994; - to develop cooperation with the countries of central and eastern Europe and with the countries of the Community of Independent States; - to give investors greater legal security by giving them the benefit of national treatment, to introduce the obligation of transparency in the treatment of investments and to give consumer countries guarantees of supply. CONTENT: - the Commission proposes, with Parliament's assent, that the Council adopt the decision on the conclusion of the Energy Charter Treaty and the Energy Charter Protocol on energy efficiency and related environmental aspects under the EC Treaty; - this text has also been submitted to the Council by the Commission as a draft decision: . for assent under the ECSC Treaty; . and for agreement under the Euratom Treaty.�

The Council presented an update of the situation as regards the European Energy Charter on the basis of a progress report submitted by the General Secretariat to the Council. In this it reaffirmed its support for the European Energy Charter, which provided a stable legal framework for long-term energy cooperation between the countries of eastern and western Europe, and repeated its resolute commitment to the Charter. According to the Council, it was extremely important that the Energy Charter Treaty should be ratified by the Member States as soon as possible and subsequently concluded by the European Communities.

The Council noted the progress of work on the negotiations concerning the second phase of the European Energy Charter. Negotiations on the Energy Charter Treaty (ECT) and on the Energy Charter Protocol on Energy Efficiency and Related Environmental Aspects were successfully completed in 1994. To date, 49 countries plus the European Union have signed the texts. Member States of the European Union are expected to complete their ratification procedures by summer 1996. The ECT is an important milestone especially because it guarantees the security of operations and supplies and pays particular attention to environmental protection. For investors it offers a basic legal framework that will make it possible to overcome obstacles, speed up negotiations and settle disputes in accordance with balanced procedural rules. However, it became clear during the negotiations that a Supplementary Treaty was necessary both in order to protect investments in the pre-investment phase and to address the issue of energy-related equipment and update the existing trade provisions in the light of the outcome of the Uruguay Round negotiations.
