As part of the ongoing exercise to simplify Community energy legislation, the Council held an exchange of views on the Commission report on a review of Community energy legislation and the communication from the Commission concerning the repeal of several Community legislative texts (three regulations and five recommendations) in the field of energy policy. Noting that its members were favourably disposed towards the proposal, the Council instructed the Permanent Representatives Committee to finalise work in the light of Parliament’s recent opinions.

In adopting the report by Mr SCAPAGNINI (FE, I), the European Parliament, considering it was desirable, in the interests of transparency, to streamline Community legislation wherever necessary: - approved the repeal of nine legislative acts in the field of the rational use of energy and oil which had either become obsolete or were now covered by later Community legislation: Recommendations 76/492/EEC, 76/493/EEC, 76/496/EEC, 77/712/EEC and 79/167/ECSC/EEC/Euratom, as well as Regulations 1055/72/EEC, 3254/74/EEC, 388/75/EEC, and 1038/79/EEC), - approved the maintenance, on a temporary basis, of Recommendation 77/713/EEC and Directive 78/170/EEC concerning the rational use of energy, and a directive concerning oil (76/491/EEC), which did not duplicate subsequent acts, - supported the temporary maintenance of two decisions (77/186/EEC and 77/706/EEC, and one directive 75/339/EEC) on the subject of oil, while calling on the Commission to submit new proposals as soon as possible in this sector which was particularly sensitive to geopolitical uncertainties. �

At the request of the "Energy" Council, the Commission has presented a report on Community legislation in the energy sector, accompanied by proposals to simplify and reduce Community legislation as and where necessary and possible. The Commission has taken account in its report of the opinions of the SAVE advisory committee (for provisions relating to energy efficiency) and of the Oil Supply Committee. Having studied both areas, i.e. the rational use of energy and oil, the Commission has proposed that the Council: A) abolish the following texts: - relating to the rational use of energy: 1. Council Recommendation 76/492/EEC on the rational use of energy by promoting the thermal insulation of buildings; 2. Recommendation 76/493/EEC on the rational use of energy in the heating systems of existing buildings; 3. Recommendation 77/712/EEC on the regulating of space heating, the production of domestic hot water and the metering of heat in new buildings; 4. Recommendation 79/167/ECSC, EEC, EURATOM on the reduction of energy requirements for buildings in the Community; 5. Recommendation 76/496/EEC on the rational use of energy for electrical household appliances; - relating to oil: 1. Regulation (EEC) No 1038/79 on Community support for a hydrocarbon exploration project in Greenland; 2. Regulations (EEC) 1055/72, (EEC) 3254/74 and (EEC) 388/75 on notifying the Commission of imports and exports of crude oil and petroleum products; B) maintain Directive 76/491/EEC regarding a Community procedure for information and consultation on the prices of crude oil and petroleum products in the Community; C) maintain, in relation to the rational use of energy: 1. Council Recommendation 77/713/EEC on the rational use of energy in industrial undertakings; 2. Directive 78/170/EEC on the performance of heat generators for space heating and the production of hot water in new or existing non-industrial buildings; D) maintain temporarily in relation to oil: 1. Decision 77/186/EEC on the exporting of crude oil and petroleum products from one Member State to another in the event of supply difficulties; 2. Decision 77/706/EEC on the setting of a Community target for a reduction in the consumption of primary sources of energy in the event of difficulties in the supply of crude oil and petroleum products; 3. Directive 75/339/EEC on minimum stocks of fossil fuel at thermal power stations.�
