summary
In adopting the report by Mr Florus WIJSENBEEK (ELDR, NL) by 226 votes to 61 with 26 abstentions, Parliament refused to waive the parliamentary immunity of Mr Bernard Tapie. While stressing that immunity existed to protect the function and not the person, the rapporteur advocated rejection of the request of the public prosecutor of Aix-en-Provence, referring to the decision of the French National Assembly which had refused to authorize the detention on remand of Mr Tapie, who held a dual national and European parliamentary mandate.
